1. Agreement to Terms
By accessing or using the services provided by RapidLanez Logistics LLC , you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Provided
The Company offers cargo van transportation services, including but not limited to:
▪︎ Local and Regional Freight Delivery: Timely transportation of goods within specified areas.
▪︎ Same-Day and Scheduled Deliveries: Flexible delivery options to meet customer needs.
▪︎ Load and Unload Assistance: Support with loading and unloading goods (if specified).
▪︎ Packaging and Labeling Services: Assistance with preparing goods for shipment (if specified).
3. Customer Responsibilities
The Customer agrees to:
▪︎ Provide Accurate Information: Ensure all shipment details, including dimensions, weight, value, and any special handling requirements, are accurate and complete.
▪︎ Proper Packaging: Ensure that all goods are properly packaged and labeled, meeting all safety and regulatory standards.
▪︎ Compliance with Laws: Comply with all applicable laws and regulations related to the shipment.
▪︎ Timely Payment: Pay all applicable fees and charges as outlined in the service agreement.
4. Prohibited Items
The Customer shall not tender for transportation any items that are prohibited by law or by the Company's policies, including but not limited to:
▪︎ Hazardous materials
▪︎ Illegal substances
▪︎ Perishable goods without proper handling instructions
▪︎ Items that exceed the weight or size limits specified by the Company
5. Liability and Claims
Limitation of Liability: The Company's liability for any claim shall be limited to the amount paid for the specific shipment in question.
Claims Submission: Claims for loss or damage must be submitted in writing within 30 days from the date of delivery.
Exclusions: The Company shall not be liable for any loss, damage, or delay caused by circumstances beyond its control, including but not limited to weather conditions, accidents, or acts of God.
6. Payment Terms
Payment Due: Payment is due upon receipt of the invoice unless otherwise agreed upon in writing.
Accepted Payment Methods: Accepted payment methods include bank transfer, check, or other agreed-upon methods.
Late Payments: Late payments may incur interest charges at a rate of 1.5% per month.
7. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the course of the business relationship.
8. Termination
Termination by Either Party: Either party may terminate this Agreement with 30 days' written notice.
Termination for Cause: Either party may terminate this Agreement immediately if the other party breaches any material term or condition and fails to remedy the breach within 15 days of receipt of written notice.
Payment Upon Termination: Upon termination, the Customer shall pay for all services rendered up to the termination date.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Indiana, without regard to its conflict of law principles.
10. Dispute Resolution
Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration in Fort Wayne, Indiana, in accordance with the rules of the American Arbitration Association.
11. Amendments
The Company reserves the right to amend these Terms of Service at any time. Any amendments will be effective upon posting on the Company's website.
