    $450 per contract
    $150 pre-listing – paid within 3 days no matter if the house sells or cancels
    $750 dual side (should it happen)
    $600 for 3+ units- listing

    $25 revision fee
    Writing Offers w/branded graphics – $100 per offer

  • Transaction Coordinator Service Agreement

    This Transactions Coordinator Service Agreement (“Agreement”) is made effective as of the date of this agent registration (“Effective Date”), by and between the registering agent (‘Agent”) and NXT Level Property Transactions, LLC, A Texas limited liability company. (“Company”)

    Together referred to as the “Parties.”

    1. DESCRIPTION OF SERVICES
    Company agrees to perform Transaction Management Services for Client. Services shall include, but are not limited to, the following responsibilities depending on whether the transaction is a Buyer-side or Listing-side transaction. Agent’s responsibilities are also defined separately below.


    Buyer Transaction Coordinator Responsibilities:

    ·        Obtain missing signatures on contracts and disclosures, as needed.

    ·        Coordinate delivery of earnest money check & confirmation.

    ·        Email executed paperwork directly to Client or Agent as preferred.

    ·        Maintain constant communication with Buyer’s Agent & Title Company.

    ·        Communicate and remind you of inspection period date, walk-through, &                   closing.

    ·        Send client information sheets to all parties.

    ·        Draft/Send repair request & amendments to contracts for Client signatures.

    ·        Confirm repair request executed prior to inspection period ending.

    ·        Ensure home warranty where applicable & send invoice to title.

    ·        Collect repair receipts/invoices.

    ·        Review closing disclosure/HUD (final approval by agent required).

    ·        Confirm final walk-through & key administration.

    ·        Confirm funds are at title office & deed is recorded.

    ·        Retrieve and upload documents needed for broker’s office compliance.

    Listing Transaction Coordinator Responsibilities:

    ·        Obtain missing signatures on contracts and disclosures, as needed.

    ·        Coordinate delivery of earnest money check.

    ·        Obtain signed copy of earnest money acknowledgement.

    ·        Email executed paperwork to Client, Lender & Title.

    ·        Maintain constant communication with Listing Agent, Lender & Title.

    ·        Handle inspection scheduling.

    ·        Send client information sheets to all parties.

    ·        Draft/Send repair requests & amendments to contracts for Client signatures.

    ·        Confirm repair request executed prior to inspection period ending.

    ·        Confirm appraisal is completed before appraisal deadline.

    ·        Ensure home warranty where applicable & send invoice to title.

    ·        Order home warranty where applicable & send invoice to title office.

    ·        Confirm survey is in if needed.

    ·        Confirm lender docs are at title office.

    ·        Review closing disclosure/HUD (final approval by agent required).

    ·        Confirm final walk-through & key administration.

    ·        Retrieve and upload all documents needed for broker’s office file compliance &             upload.

    Agent Responsibilities:

    ·        Keep constant communication with Client, co-operating agent, and Transaction           Coordinator.

    ·        Upload or send documents to TC in timely manner.

    ·        Obtain quotes from vendors if needed or pay an additional $75 for services.

    ·        Negotiate all repairs (TC will prepare the repair request for signatures).

    ·        Handle appraisals, terminations, and negotiations with Client/agent.

    ·        Advise clients on contractual obligations and major decisions.

    ·        Review settlement statement (HUD) for accuracy.

     *Scope Limitations

    Agent understands and agrees that the Company will NOT perform any negotiations of contracts, repairs, legal duties, or appraisals on Agent’s behalf. Company’s role is strictly limited to transaction coordination services as outlined in this Agreement. All negotiations, repairs, appraisals, and legal obligations remain the responsibility of the Agent.

     

    2. PAYMENT TERMS
     

    Agent agrees to the following Transaction Coordinator Fees for the services listed below:

    Ø  $450 per contract

    Ø  $150 pre-listing – paid within 3 days no matter if the house sells or cancels

    Ø  $750 dual side (should it happen)

    Ø  $600 for 3+ units- listing

    Ø  $500 for 3+ units- buy side

    Ø  $25 revision fee

    Ø  Writing Offers w/branded graphics – $100 per offer

    - Late Fees: Payments are due within 3 business days of closing. Unpaid Fees after 3 business days will accrue an additional 10% of the service rendered amount.


    3. TERM & TERMINATION
    This Agreement has no end date and continues until terminated by either party upon 5 calendar days’ written notice. All completed work must be paid for before termination. If termination occurs after the option period, 50% of the transaction fee will be due. Agent will not be charged for cancellations of contracts where escrow did not close.

    4. RELATIONSHIP OF PARTIES
    Company is an independent contractor and not an employee of Agent. Company determines daily schedule and work hours. Company agrees to be available to provide services during reasonable hours and reserves the right to identify any day or hours of unavailability in writing to Agent in advance.

    5. CONFIDENTIALITY
    Company agrees to hold Agent’s information in strict confidence, including buyer/seller lists, leads, business practices, pricing, and documents. Company shall not copy, modify, or disclose Confidential Information except as required to perform services. Confidentiality survives termination of agreement.

    6. NON-DISCLOSURE & NON-SOLICITATION
    - Company shall not disclose Agent’s confidential information to third parties.
    - Company shall not solicit or attempt to solicit Agent’s customers, or contacts for in perpetuity after termination.
    - Company shall not circumvent Agent for the purpose of profiting from referrals or contacts introduced by Agent.

    7. INDEMNIFICATION & LIMITATION OF LIABILITY
    Each party shall indemnify and hold harmless the other against claims arising from material breach of this Agreement. Company shall not be liable for errors in information provided by Agent, including property data, tax information, or legal/negotiation issues. In no event shall Company’s liability exceed the total fees paid under this Agreement.

    8. NON-DISPARAGEMENT
    Agent agrees not to publish or disseminate unlawful, defamatory, or misleading statements about Company or services rendered.

    9. FORCE MAJEURE
    Neither party is liable for delays caused by natural disasters, government actions, pandemics, labor disputes, or other events beyond reasonable control.

    10. GENERAL PROVISIONS
    - Amendments must be in writing and signed by both parties.
    - Governing Law: Texas law applies; both parties waive the right to jury trial.
    - Severability: If any clause is unenforceable, the remainder of the Agreement remains valid.
    - Entire Agreement: This document contains the entire understanding between the Parties and supersedes all prior agreements.
