Utah Resident Student Status for College Tuition – Summary
General Rule:
To qualify as a resident student and pay in-state tuition at a Utah public college, most students must:
Live in Utah for at least 12 continuous months before applying.
Show proof of living in Utah (like a driver’s license, job, voter registration, or lease).
Say they’ve given up residency in other states.
Students who are dependents of out-of-state parents cannot qualify as residents unless an exception applies.
Exceptions – Who Automatically Gets In-State Tuition:
You qualify for resident status (in-state tuition) even if you don’t meet the 12-month rule if you are:
Active Military Members and their families
Veterans and their families
Foreign service employees (like diplomats) and their families
People using VA education benefits
Refugees, asylees, or those with special immigrant visas
Inmates (while in prison and for one year after release)
Department of Defense (DOD) employees and their families
Members of Utah tribes or American Indians who graduated from a Utah high school
Job Corps students
Spouses of Utah residents, if they move to Utah and show proof of residency
Students with one Utah parent who has lived in Utah for at least 12 months
People who moved to Utah for a full-time job, not just to go to school
Olympic athletes training in Utah
People who moved to Utah due to a divorce, death of a spouse, or to care for a family member’s long-term health
Other Important Notes:
If you keep enrolled continuously, you keep your resident status even if your family moves.
Rules may differ slightly between colleges, but they must follow this law.
A student is exempt from paying nonresident tuition (even if not a legal resident) if:
They are legally in the U.S.,
Attended a Utah high school for 3+ years, and
Graduated from a Utah high school or got a GED in Utah.
ALTERNATIVE DOCUMENTATION FOR UTAH RESIDENCY:
☐ Utah driver license or ID
☐ Utah voter registration
☐ Utah vehicle registration
☐ Utah lease/rental agreement
☐ Utah utility bills
☐ Utah tax return filed as resident
☐ None of the above
EXCEPTIONS
☐ Active duty military or veteran
☐ Foreign service member or DOD civilian
☐ Member of a Utah-recognized tribe
☐ Refugee, asylee, or SIV holder
☐ Incarcerated or formerly incarcerated in Utah
☐ Utah Job Corps student
☐ Moved to Utah for full-time employment
☐ None of the above
