WEBSITE DESIGN AND OWNERSHIP

This Agreement is made between Click Wise Design (“Designer”) and the undersigned (“Client”).

1. Website Design & Ownership

Designer agrees to design a website for Client, including a home page, about page, contact page, and up to 6 service pages, at no cost.

Upon completion (including up to 4 revisions), Client will have full and exclusive ownership of the domain, website, and all content (text, graphics, images, logos, etc.), except as limited by the Template & Layout Protection clause.

2. Revisions

Designer will provide up to 4 revisions at no cost. Additional revisions may incur extra fees.

3. Hosting & Maintenance

Client agrees to exclusively use Click Wise Design for hosting and maintenance for a minimum of 5 months at $84/month. Early termination requires immediate payment of the remaining balance for the 5-month term. After this period, Client may choose another hosting provider but may not transfer the website to another agency for hosting/maintenance.

4. Template & Layout Protection

Client owns the completed design but may not duplicate, distribute, or repurpose it for other projects without written consent from Click Wise Design.

5. Payment Terms

Invoices must be paid within 5 days. All payments are non-refundable. No chargebacks are allowed.

6. Liability & Disclaimer

Designer is not liable for any damages (direct, indirect, incidental, etc.) arising from use of the website. The website is provided “as is” without warranties. Client is responsible for ensuring the website meets their requirements.

7. Indemnification

Client agrees to indemnify and hold harmless Designer from any claims arising from Client’s use of the website.

8. Governing Law

This Agreement is governed by Texas law, with disputes resolved in Collin County, Texas.
