Trail Volunteer Liability Waiver Form

The undersigned, being at least eighteen years of age, and in consideration of participation in the

Friends of Herriman Trail event/program as described above (hereinafter event/program), does

hereby agree to this waiver and release of Friends of Herriman.

I do hereby agree to assume all risks which may be associated with or may result from, my

participation in this event/program, including but not limited to the actual course of activities or

while using any facility, parking lots, transportation or access to City trails and recreation sites.

I recognize that participation in the event/program may involve moderate to strenuous physical

activity and may cause physical and or emotional distress to participants, up to and including

death. There may also be associated health risks. I state that I am free from any known heart,

respiratory or other health problems that could prevent me from safely participating in any of the

activities.

Volunteer does hereby release, forever discharge, covenant not to sue, and hold harmless the

Friend of Herriman, its officials, employees, representatives, and agents from any and all

liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise

or may hereafter arise from Volunteer’s Activities on behalf of the Friends of Herriman.

Volunteer understands that this Release discharges the Friends of Herriman from any and all

liability or claim that the Volunteer may have against the Friends of Herriman with respect to

bodily injury, personal injury, illness, death, or property damage that may result from

Volunteer’s Activities with the Friends of Herriman. Volunteer also understands that the Friends

of Herriman does not assume any responsibility for or obligation to provide financial assistance

or other assistance, including but not limited to medical, health, or disability insurance in the

event of injury or illness.

I certify that I have medical insurance or otherwise agree to be personally responsible for costs of

any emergency or other medical care that I receive.

I further agree to release Friends of Herriman and its agencies, departments, officers, employees,

agents and all sponsors, officials and staff or volunteers from any and all liability, claims,

demands, breach of warranty, negligence, actions, and causes of actions whatsoever for any loss,

claim, damage, injury, illness, attorney’s fees or harm of any kind or nature to me arising out of

my participation in the event/program. This release extends to any claim made by my family,

estate, heirs, or assigns arising from or in any way connected with the aforementioned activities

Volunteer does hereby grant and convey unto the Friends of Herriman all right, title, and interest

in any and all photographic images and video or audio recordings made by the Friends of

Herriman during the Volunteer’s Activities with the City, including, but not limited to, any

royalties, proceeds, or other benefits derived from such photographs or recordings.I have carefully read and understand the contents of the foregoing language and I

specifically intend it to cover my participation in the above stated event/program.
