SERVICE AGREEMENT
This Service Agreement (“Agreement”) is made between Cre8fully (“Company”) and the undersigned client (“Client”). By signing this Agreement, the Client agrees to the following terms and conditions:
General Statement
At Cre8fully, our mission is to provide high-quality web design, development, and digital services that support your business growth. While we prefer to operate on trust and professionalism, this Agreement exists to protect both parties. It ensures clarity, sets expectations, and establishes a foundation of fairness.
Simply put: if we treat each other with respect and integrity, this will remain just a formality.
Scope of Services
Cre8fully will provide services based on the Client’s selected plan. These may include:
Website design & development
Hosting (via our platform)
Security (via our platform)
Website updates (limited hours included per plan or billed hourly for additional work)
Only the services listed in the Client’s plan will be provided unless otherwise agreed to in writing.
Payment Terms
Initial & Recurring Fees
The Client agrees to pay an initial investment (as outlined in the project proposal) followed by recurring monthly fees for hosting, maintenance, or other ongoing services.
Payments are processed securely through third-party processors (e.g., Stripe, PayPal). Cre8fully does not store sensitive payment details.
Automatic Payments
Monthly auto-pay begins on the website launch date and recurs on the same calendar day each month.
Service cancellation requires written notice at least 15 days prior to the next billing cycle.
Failed Payments
If a payment fails, our processor will retry up to three (3) times over three days.
If still unpaid, Cre8fully may suspend services (including hosting and marketing) until payment is received.
Invoicing Option
A $35 late fee or 10% of the overdue balance (whichever is greater).
Suspension of services until the account is current.
Non-Payment
Repeated late or missed payments are considered a material breach of this Agreement.
Cre8fully reserves ownership of all work, intellectual property, and hosting rights until all balances are cleared.
Revisions
The Client is entitled to one round of revisions after project completion. Revisions are limited to minor edits (text, images, small layout adjustments) requiring no more than two hours. Major design changes, new pages, or custom coding will be billed separately.
All proprietary design methods, tools, and processes remain the property of Cre8fully.
Client Access & Updates
To maintain functionality and prevent errors, direct editing access by Clients is restricted.
Clients who wish to self-host or self-manage may do so by paying a one-time design/export fee. Future assistance will then be billed hourly ($85–$125/hr).
Clients on monthly plans may request updates (text, images, small edits) within included service hours. Larger modifications may incur additional fees.
Confidentiality
Both parties agree to maintain confidentiality regarding business practices, proprietary tools, pricing, and sensitive information.
Termination
Clients may cancel services with 30 days’ written notice sent to: support@cre8fully.com.
Cancellation during an active billing cycle may result in prorated or additional charges.
Governing Law
This Agreement will be governed by the laws of the State of Nevada, United States.
Client Responsibilities
At Cre8fully, we value professionalism and mutual respect. To ensure a smooth working relationship, the Client agrees to:
Communicate clearly and in a timely manner.
Treat Cre8fully staff, contractors, and partners with respect.
Avoid public defamation, negative posts, or reviews without first allowing Cre8fully the chance to address concerns.
Keep pricing and plan details private, as they may vary by project scope.
Cre8fully does not guarantee specific outcomes (such as first-page Google rankings), nor are we responsible for damages caused by Client mismanagement, third-party tools, or unrealistic expectations.
Third-Party Software & Compliance
Cre8fully relies on third-party platforms (hosting, marketing tools, etc.). The Client agrees that Cre8fully is not liable for downtime, performance issues, or losses caused by these platforms.
Privacy & ADA Compliance: Standard Privacy Policy, Terms of Service, and Disclaimer will be provided (via Termageddon or another provider). However, ultimate responsibility for compliance rests with the Client. Legal advice should be sought from a licensed attorney.
Indemnification
The Client agrees to indemnify and hold harmless Cre8fully, its employees, and contractors from any claims, liabilities, or damages related to:
Client-provided content
Third-party services/platforms
Regulatory or compliance failures
Acceptance
By signing or submitting this form, the Client acknowledges they have read, understood, and agree to the terms outlined above. This Agreement remains valid until terminated in accordance with the terms herein.
