VOLUNTEER RELEASE & WAIVER OF LIABILITY
1. Waiver and Release. The “Volunteer” releases and forever discharges and holds harmless Haven Homes (HH) and its successors and assigns from any and all liability claims, and demands of whatever kind of nature, either in law or in equity, which arises, or may hereafter arise, from the “Volunteer’s” work with HH. The “Volunteer” understands and acknowledges that this “Release” waives and discharges HH from any liability or claim that the volunteer may have against HH with respect to any bodily injury, personal injury, illness, death, or property damage that may result from the “Volunteer’s” participation with HH, whether caused by negligence of HH or its directors, officers, employees, or agents or otherwise. The “Volunteer” also understands that HH does not assume any responsibility for, or obligation to, provide financial assistance or other assistance; including but not limited to, medical, health, or disability insurance. In the event of injury, illness, death, or property damage, see insurance requirements below. The “Volunteer” also acknowledges and agrees to vacate any and all premises owned by HH when and/or if they are asked to leave, with or without and/or all of their own belongings at whatever time an employee of HH asks them to leave.
2. Insurance. The “Volunteer” understands that, except as otherwise agreed to by HH in writing, HH does not carry or maintain health, medical, disability insurance coverage for any “Volunteer” and the “Volunteer” is solely responsible for his own medical bills.
3. Medical Treatment. The “Volunteer” realizes that by volunteering at Haven Homes he/she may be exposed to illness, diseases, bodily fluids, etc. The “Volunteer” is solely responsible for washing their hands and/or using gloves if they are concerned that they will be exposed to bodily fluids, etc. The “Volunteer” hereby releases and forever discharges HH from any claim whatsoever which arises, or may hereafter arise, on account of any first aid, medical treatment, or other services rendered in connection with the “Volunteer’s” duties with HH.
4. Personal Precautions. I have read and understand the Personal Precautions set down by HH and agree to be dedicated, responsible, careful and cautious in my interactions with the residents of HH.
5. Photographic/Media Release. The “Volunteer” grants and conveys unto HH all right, title, and interest in any and all photographic and media images, video, and audio recording made by HH or an affiliate during his/her stay with HH, including but not limited to any royalties, proceeds, or other benefits derived from such photographic media or recordings. Such photographs and media recordings may be used for advertising, news, release, websites, social media, and educational materials. The “Volunteer” agrees to allow HH to use their likeness and identity in descriptive audio, video, and/or commentary. All photographs, video, and audio media will remain the property of HH.
6. Background Check. The “Volunteer” realizes the importance of protecting the integrity of the ministry of HH and agrees to let HH run a personal background check, realizing that HH staff is only looking for information as it relates to sexual and/or violent offenses in accordance with the guidelines and policies of HH.
7. Other. The “Volunteer” expressly agrees that this “Release” is intended to be as broad and inclusive as permitted by the State of Texas in the United States of America, and that the “Release” shall be governed by and interpreted in accordance with the laws of the State of Texas. The “Volunteer” agrees that in the event that a clause or provision of the “Release” shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause of provision shall not otherwise affect the remaining provision so this “Release” which shall continue to be enforceable. I understand that if at anytime the staff at HH feels that I cannot remain responsible, careful, and cautious in my dealings with the residents that the staff of HH may at any time, for whatever reason, decide to terminate the project, activity, or my volunteer participation. Volunteers may at any time, for whatever reason, elect to discontinue their participation. Notice of such decisions will be provided by the staff of HH in a manner that is as timely and convenient as possible. Notice by volunteers should be communicated as soon as possible to the Director. To express understanding of the “Release”, the “Volunteer” signs below with a witness as acknowledgement. Signing this form, the “Volunteer” acknowledges that they have received training and understand the guidelines and procedures as set forth by HH.
