MODEL RELEASE

By signing below, I (Client) am agreeing to: 

Sunflower Shutters Photography has the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself and/or my minor child in which she may be included with others:

 To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising, trade, share images from my session on social media and for marketing purposes without compensation. 

 I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.

Sessions

All sessions include the digital portraits delivered via online digital gallery. With each gallery you will have the ability to download the photos straight to your computer/device and I also include the rights to print. Time lines do vary- the type of shoot has a lot to do with when you will recieve images.

Once you recieve the images, they are yours to print or do with what you want; however you are not to edit them, as the photographer, Sunflower Shutters I hold the rights to the photos, even though they are yours. If you are unhappy or would like something simple like one photo in black and white, I am happy to do that, just message me and we will get it done.

All photoshoots come with different things however all come with digital images that you can download straight to your phone/ tablet/ or computer, hassle free

CONTRACT

A non-refundable retainer is required at time of booking in order to save your session date. This is not an extra charge and will be applied toward the session fee. The remaining fee is due 7 days before the session, only applies to weddings, events- all other sessions are due day of booking unless agreed upon prior to.

ALL fees are nonrefundable.

Weddings, Events and Boudoir require half to book remainder of payment is required within 7 days of sessions

Invoice will be sent upon agreement on date and time, and invoice must be paid 7 days prior to your session.

What is a Retainer and Why Is It Non-Refundable?

When you book a session with me, a non-refundable retainer is required to reserve your date and time. This means I block that slot off my calendar just for you and I don’t accept any other bookings for that time.

Because I turn away other potential clients once your date is secured, if you cancel, it’s not just about the time lost it’s also about the income I’ve lost from other clients I could’ve served.

 The retainer helps protect both of us. It ensures your spot is saved, and it provides a small portion of compensation for my time and planning in the event of a cancellation.

If the retainer is not submitted within 24 hours, this contract will be null/void and the session will be cancelled.

The remaining portion of the session fee is due 7 days before the session. If the session fee is not submitted at the time of the invoice, the session will be canceled unless client has communicated with photographer. If client has communicated a financial hardship, and photographer has agreed to still shoot the session, please note that NO images will be edited or released prior to the balance being paid in full. After such time, the images from the session are subject to being permanently deleted if balance is not paid. The promise of quick turnaround time does not begin until balance is paid. 

If the retainer is not submitted within 24 hours of picking your date, this contract will be null/void and the session will be cancelled.

If client has communicated a financial hardship, and photographer has agreed to still shoot the session, please note that NO images will be edited or released prior to the balance being paid in full. 

The content of the gallery is in discretion of Sunflower Shutters Photography. We will select the best images and edit them to her discretion. Any further editing or culling will be subjected to fee.

Images are delivered via instant digital download via Google Drive

Events, Weddings, Quince's and larger events can take up to 45 days to deliver images however in MOST cases images are delivered within 30 days.

Smaller sessions including but not limited to Family photos, Mini sessions, Seasonal sessions, Proposals, Birthday's, and similar sessions will be completed and delivered within 7 calander days;however sometimes there are circumstances in which you will get them prior to that time frame, which is most common.

Client is responsible for making a backup of all photos from the digital download Photographer will make every attempt to keep archival copies of photos, but does not guarantee that they will be retained indefinitely. Should you lose your photos and need the photographer to re-upload them, there is a re-upload fee of $75.

COOPERATION: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Sunflower Shutters Photography is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to Sunflower Shutters Photography. Client shall assist and cooperate with Photographer in obtaining desired photographs. Photographer shall not be responsible for photographs not taken as a result of Client’s failure to provide reasonable assistance or cooperation.

CLIENT agrees to carefully select wardrobe and make sure it is free of wrinkles and stains. Client must also feel comfortable in what they are wearing. Sunflower Shutters Photography is not responsible for the following: wardrobe malfunctions, wrinkles, stains, panty lines, undergarments showing, skin color variations due to natural sun or self-tanning, tags/stickers on clothing, chipped manicure/pedicure, deodorant residue or just simply no longer liking your wardrobe choice.

Client will be respectful to Photographer and all parties being photographed. Photographer has the right to end the session, without refund, if there is lack of cooperation or respect.

Client will not hold Photographer or the owner of the property liable for any injury that may occur during the session.

Should anyone within your family/party become ill before your session, please let Us know immediately.  Should anyone attend a session and is visibly ill, it is within Us right to reschedule the session immediately. 

(Due to the nature of my work, I am required to be very careful with what I allow myself to be around. Thank you for understanding.) 

Client understands that by entering into this agreement, Photographer is foregoing other photographic jobs. In the event of a cancellation or postponement of the portrait session/agreement by Client, the retainer paid is non-refundable, as all fees are non-refundable.  If it is not possible for a session to take place on a scheduled day due to weather, Photographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge. Session must be rescheduled with in 6 weeks, if not a new retainer must be paid. 

Any Client that is late arriving to the session will have the amount of time late deducted from the time allotted for the session. If Client chooses to go over the allotted time due to being late or just wanting a few more shots, the client will be billed the difference for the next higher session package. Clients shall not be compensated for the time deducted from session due to late arrival of client. I advise arriving to session 5 minutes early so we can start on time.

Sunflower Shutters Photography will retain the full copyright on all images (including digital files) and reserves the right to display, publish/etc. for any reason. Client is prohibited from further editing of images. Client is also prohibited from using photos in contests without written consent from Sunflower Shutters Photography (Stormie Worbington). Client may not, for any reason sell their images to any third party. Client will be granted printing rights in writing for the images and is allowed to download and use digital files for printing purposes and their chosen vendor.
