  • What is this about?

    Following the Pre-submission (Regulation 14) Consultation held in Autumn 2024 a revised version of the Neighbourhood Plan has now been prepared which reflects the responses received. This document, together with appendices, is available to read on the Parish Council website. A document itemising the responses and an explanation of how they have been dealt with, is also available on the website. Before the Plan is finally submitted we are taking the opportunity to consult again to confirm that this latest version is acceptable to as many of the community and other stakeholders as possible.

    How do I view the Plan and provide comments?

    A copy of the revised Plan can be viewed on the same Neighbourhood Plan pages of the Parish Council website where the link to this form is located. Please read the Plan and then complete this form to provide comments.

    What can I comment on?

    You can comment on any aspect of the Plan. We have provided space for comments after the individual questions and there is also space for any additional comments at the end of the questionnaire (Q34) which can be about the process which has been followed or anything else connected to the Plan, as well as the Plan itself.

    You do not have to answer all the questions. Please answer as many as you wish - every response we receive is important.

    Please note that if you hold the same views as you did when the last consultation was carried out and wish to have those comments re-considered at this stage, you will need to set them out again on this Consultation response form.

    What other information do I need to provide?

    Please provide your name and contact details. The comments which you make now may, in due course, be made available on the community website for others to see, although the only element shown alongside your comments will be your name. Your contact details are needed as these have to be passed on to the Local Planning Authority so that they can keep you fully informed about progress later on as the Plan moves towards becoming part of the formal Planning Policy for the area.

    Who can respond?

    As well as consulting with residents aged 16 years and over we are also seeking comments from people who work or operate within the Plan Area. In addition, we are once more contacting stakeholders such as the major employers, local organisations and groups with whom we consulted previously. Any other stakeholder or anyone else with a specific interest in the area can also respond. We are also asking all the relevant statutory bodies for their comments including local government departments, utility and service providers, neighbouring Parish Councils etc. as is required under Neighbourhood Planning legislation.

    The views and information you provide in this document will help to shape the future of the Kirkby Malzeard, Laverton and Dallowgill parish area in the years to come. Please take this opportunity to let us know what you think of the proposed Policies and Parish Actions, so that we can make this area an even better place in which to live and work.

  • This Consultation runs from 20.10.2025 until 15.12.2025. The Consultation will then be closed and representations after that cannot be accepted.

However, copies of the responses together with your name and contact details will be provided to the Local Planning Authority (North Yorkshire Council) as they need to keep you informed of progress later in the process.

  • Q2. Do you agree with Policy KMLD1 which seeks to ensure that if ‘major’ developments will have an adverse impact on highway and pedestrian safety in Kirkby Malzeard, then appropriate upgrading work must be undertaken to the infrastructure to alleviate impacts prior to the development being completed.
  • Q3. Do you agree with Policy KMLD2 which seeks to ensure that in similar circumstances to those referred to for KMLD1, any upgrading work necessary to the sewerage network in Kirkby Malzeard is also undertaken prior to development being completed.
  • Q4. Do you support Parish Action 1 which requires that the Parish Council lobby North Yorkshire Council to include all existing housing in Kirkby Malzeard within the Development Limits when drawing up their next Local Plan.
  • Q5. Do you agree with Policy KMLD3 which is intended to ensure that there is a housing mix on all new developments which better reflects the needs of the community by providing more homes with 2 or 3 bedrooms, rather than 4 or more.
  • Q6. Parish Action 2 concerns the use of a rural exception site if necessary to provide affordable housing. Do you agree with this approach?
  • Q7. Do you agree with Policy KMLD 4 which indicates that planning applications to lift agricultural occupancy restrictions will not be considered within the first ten years of the original consent being granted?
  • Q8. Parish Action 3 also deals with verifying that properties built with agricultural occupancy restrictions are only being used by such workers rather than by anyone else. Do you agree with this?
  • Q9. Do you agree with Policy KMLD 5 which supports conversions of rural buildings to dwellings providing they will not adversely affect landscape values?
  • Q10. No Policies or Parish Actions have been included in respect of Holiday Lets or Second Homes as there have been actions taken recently at county level, and further actions currently under consideration at national level, the effect of which is awaited. Do you agree with this approach, or do you feel further action is needed here now?
  • SECTION 6 - HERITAGE AND THE BUILT ENVIRONMENT

  • Q11. Do you agree with the principle behind Policy KMLD6 which deals with the classification of Non-Designated Heritage Assets and do you have any comments about those buildings or structures which have been suggested?
  • Q12. Do you agree with designation of an Area of Local Character and Heritage in the area in and around Church Street, Kirkby Malzeard as set out in Policy KMLD7?
  • Q13. Policy KMLD8 sets out design criteria for new buildings and extensions. Do you agree with these?
  • SECTION 7 - NATURAL ENVIRONMENT

  • Q14. Do you agree with Policy KMLD9 which seeks to ensure that future development should conserve and enhance the natural beauty of this National Landscape area?
  • Q15. Seven areas in and around Kirkby Malzeard have been identified as Local Green Spaces in Policy KMLD10. Do you agree with the idea behind this and the inclusion of these specific sites?
  • Q16. Parish Action 4 deals with the provision of an allotment/community garden. Do you agree that this should continue to be pursued by the Parish Council?
  • Q17. Do you agree with the zoning proposals to conserve ‘Dark Skies’ included in Policy KMLD11?
  • Q18. Policy KMLD12 is included within the Plan to help towards the protection and enhancement of biodiversity in our local area. Do you agree with the proposed measures?
  • Q19. Tree Preservation Orders are seen as a useful tool to protect trees or groups of trees. Do you agree that this method set out in Parish Action 5, should be used, where appropriate, by the Parish Council to extend the number currently protected?
  • Q20. Parish Action 6 seeks to support native tree planting schemes in the area. Do you agree with this?
  • SECTION 8 - COMMUNITY FACILITIES

  • Q21. Eight facilities which are particularly important to the community have been identified in Policy KMLD13 in order to provide additional protection against any future development which may adversely affect them. Do you agree with those selected and the purpose behind doing so?
  • Q22. Parish Action 7 seeks to encourage the expansion of facilities for younger people in the community. Do you agree that this is necessary?
  • Q23. Do you agree that there is a benefit in the eight facilities referred to in Policy KMLD13 being considered by the Parish Council for Listing as Assets of Community Value (ACVs) as referred to in Parish Action 8?
  • Q24. Do you also agree that if they are Listed as ACVs then the proposals set out in Policy KMLD14 are important and that their ACV Listing should be relevant when any future planning application is being considered?
  • SECTION 9 - INFRASTRUCTURE

  • Q25. Highway Safety, particularly on Main Street in Kirkby Malzeard, is seen as an area of concern by the community. Do you agree that the Parish Council needs to work with partners such as NYC Highways to improve safety wherever possible as set out in Parish Action 9?
  • Q26. Policy KMLD15 seeks to strengthen rules around the provision of off-street parking where development is being carried out. Do you agree that this is important?
  • Q27. Parish Action 10 outlines the idea of creating a public parking area on a section of The Green, including if practical the provision of ULEV charging points. Do you agree that this approach should be explored further by the Parish Council?
  • Q28. Parish Action 11 hopes to result in improvements to local bus services. Do you agree that this is important to our rural community?
  • Q29. Steps to encourage the provision of an Ultra Low Emissions Vehicle charging network are covered in Policy KMLD15. Do you agree with this Policy?
  • Q30. That the Parish Council should take measures to promote the use of the Public Rights of Way network and ensure that necessary maintenance is carried out is referred to in Parish Action 12, with expansion of the network also to be investigated. Do you agree with this?
  • Q31. As surface water flooding is now seen as an increasing risk due to the climate change do you agree that it is important that the Parish Council should do all it can to ensure that issues do not arise wherever possible, as covered in Parish Action 13?
  • SECTION 10 - LOCAL ECONOMY

  • Q32 Policy KMLD17 is intended to support specific types of development to aid the local economy. Do you feel that the measures incorporated are correct?
  • Q33. The Parish Council will take an active role inpromoting local business in ways which are described in Parish Action 14. Do you agree with these?
