  • VENDOR GUIDELINES & RULES

  • 1. INDEMNIFICATION

    Participating vendors shall indemnify and hold harmless the Town of Chesapeake Beach and its officials, employees and agents from any and all liabilities, judgements, settlements, losses, costs or charges (including attorneys' fees) incurred by the Town of Chesapeake Beach or any of its officials, employees or agents as a result of any claim, demand, action or suit relating to any bodily injury (including death), loss or property damages caused by, arising out of, related to or associated with the use of the property or the participation of the vendor or by the vendor's employees, agents or invitees in Town of Chesapeake Beach events for the year 2025.

    2. LICENSE AND PERMIT REQUIREMENTS

    Provide the Town a copy of the Calvert County Health Department Special Event Permit or Catering License if applicable.

    3. INSURNACE

    Provide the Town a Certificate of Insurance naming The Town of Chesapeake Beach as an additional insured with respect to general liability if applicable. 

    4. OPERATING REQUIREMENTS

    Vendor is responsible for himself/herself and his/her employees, his/her subcontractors, materials, equipment, and all insurance to protect him/her and/or others.

    5. LOCATION

    All space assignments are final. Spaces are assigned based on items sold. The Town shall, in its sole discretion, have the final decision about how space is allocated. The Town reserves the right to change the Vendor's space without notice or consent at any time. 

    6. HOURS OF OPERATION

    Set up time starts one hour before each event unless approved by town personnel. Vendors must be completely set up by the start of the event.

    7. SET-UP AND CLEAN-UP

    A. Vendors are responsible for bringing your own tables, chairs, tablecloths, and plastic covers or something to keep your merchandise dry in case of rain.

    B. Tents or canopies may be used and must be secured for safety and to avoid injury or damage to property and/or patrons.

    C. Vendors are required to make immediate safety changes when directed to do so by Town of Chesapeake Beach personnel.

    D. No disposal services will be provided by the Town. Trash receptacles are provided for park patrons but are not to be used by the Vendor for the Vendor's clean-up. The Town may charge and the Vendor shall pay a fee for the actual costs, including staff time, incurred by Town as result of the Vendor's failure to clean up as specified here.

    8. VIDEO AND PHOTOGRAPHY RELEASE

    The Vendor hereby grants to the Town the irrevocable and unlimited right and permission to use photographs and/or video recordings of the Vendor, the Vendor's intellectual property, and the Vendor's property on the Town's social media accounts and website, publications, promotional flyers, marketing materials, derivative works, or for any other similar purpose without compensation or permission from the Vendor. The Vendor hereby releases, acquits, and forever discharges the Town from all claims, demands, rights, promises, damages, and/or liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any claims for invasion of privacy, appropriation, likeness, or defamation.

    9. TAX REMITTANCE

    The Vendor shall be responsible for the collection, reporting and payment of all state, local, and federal taxes related to products sold.

    10. RESTRICTIONS

    The following items ARE NOT allowed to be sold at this Event:

    A. Any type of silly string; fart gas; artificial tobacco products of any type; any type of drug paraphernalia; any form of firecracker or fireworks; no live animals/reptiles/birds; t-shirts or other items containing sexual content or profanity; no swords or knives; additional items may be prohibited, and each item will be reviewed.

    B. No electric will be provided, and generators are not allowed without advanced written permission from Savannah Richardson at the Town of Chesapeake Beach.

    C. Any vendor found selling these items or the like, will be asked to leave the event and will not be entitled to any future events.

    11. NON-DISCRIMINATION

    The Vendor and its employees shall not discriminate against any employee, patron, visitor, attendee or customer because of race, color, religion, sex, gender identity or expression, national origin, age, disability, familial status, marital status, sexual orientation, or other protected status.

    12. VIOLATIONS

    The Town may revoke Vendor privileges for any activity that is found to be in violation of any ordinance, law or conditions of approval. In the event the Vendor is not ready to vend at the designated time or if the Vendor arrives in a condition that gives the appearance of being incapable of operating vending site in safe and commercially acceptable manner, the Vendor shall be deemed to have violated these terms and the Town shall have the right, at its sole discretion, to revoke all privileges.
