EBIKE RENTAL WAIVER AND RELEASE OF LIABILITY FOR MINOR

I, {fullName} the parent or legal guardian of {minorName}, a minor born on {minorBirth} hereby acknowledge and agree to the following terms to permit the minor to rent and operate an electric bicycle (“eBike”) from Cyclerie LLC for the rental period beginning on {startDate} and ending on {endDate}.

Acknowledgment of Risks: I understand that renting and operating an eBike involves inherent risks, including but not limited to falls, collisions, equipment failure, road hazards, traffic accidents, and other unforeseen incidents that may result in serious injury, disability, or death. I acknowledge that eBikes are motorized vehicles requiring skill and caution to operate safely, and that the minor’s use of the eBike is voluntary.
Assumption of Risk: On behalf of myself and the minor, I knowingly and freely assume all risks associated with the rental and use of the eBike, both known and unknown, even if arising from the negligence of CyclErie LLC, its employees, agents, or affiliates (“Releasees”), and I accept full responsibility for the minor’s use of the eBike.
Release and Waiver: In consideration for allowing the minor to rent and use the eBike, I, for myself, the minor, and our respective heirs, assigns, and representatives, hereby release, waive, discharge, and agree not to sue Releasees from any and all liability for any claims, damages, injuries, or losses, including personal injury, property damage, or wrongful death, arising out of or related to the minor’s rental or use of the eBike, whether caused by negligence or otherwise.
Compliance with Laws and Safety Requirements: I confirm that the minor will comply with all applicable Colorado laws, including but not limited to wearing a helmet as required under C.R.S. § 42-4-1412 for minors under 18 operating eBikes. The minor will also follow all safety instructions provided by CyclErie, including proper operation and care of the eBike, and will use the eBike only in permitted areas.
Health and Ability: I certify that the minor is in good physical health and has no conditions that would prevent safe operation of the eBike during the rental period. I have informed CyclErie LLC of any relevant medical conditions or limitations that may affect the minor’s ability to safely operate an eBike.
Equipment Responsibility: I agree that the minor will use the eBike in a careful and reasonable manner and return it to CyclErie LLC in the same condition as received, normal wear and tear excepted. I understand that I am responsible for any loss, theft, or damage to the eBike during the rental period, and I agree to cover the cost of repairs or replacement as determined by CyclErie LLC.
Parental Consent: As the parent or legal guardian, I consent to the minor’s rental and use of the eBike and confirm my authority to enter into this agreement on the minor’s behalf. I understand that this waiver is binding in accordance with Colorado law.
Emergency Authorization: In the event of an emergency, I authorize CyclErie LLC to secure medical treatment for the minor if I cannot be reached at the time of the incident.
Governing Law: This agreement shall be governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising hereunder shall be resolved in the courts of Weld County, Colorado.
I have read this waiver and release of liability, fully understand its terms, and sign it freely and voluntarily without any inducement. I understand that I am giving up substantial rights on behalf of myself and the minor by signing this document.
