This waiver applies to scenarios where the minor rides alone or where I, the parent/guardian, rides along with the minor on an e-bike.

Acknowledgment of Risks

I understand that test riding a Bike involves inherent risks, including but not limited to falls, collisions, equipment failure, road hazards, traffic accidents, and other unforeseen incidents that may result in serious injury, disability, or death. I acknowledge that eBikes are motorized vehicles, heavier than traditional bicycles due to their battery and motor, and require skill and caution to operate safely. Cargo bikes may also handle differently due to their size and weight. The minor’s participation, whether riding alone or with me on a cargo bike, is voluntary.

Safety Instructions and Compliance
I certify that a representative of Cyclerie, LLC has explained, and I and/or the minor understand, how to:

Operate the gears and brakes.
Operate the pedal-assist controls (if applicable).
Operate the throttle-assist controls (if applicable).
I agree that the minor will:

Wear a Snell or ANSI-approved bicycle helmet at all times during the test ride, as required for minors under 18 under Colorado law (C.R.S. § 42-4-1412).
Start the ride with the pedal-assist mode set to off or zero (if equipped) and get accustomed to the Bike before using faster modes.
Ride only in areas designated by Cyclerie, LLC and ensure the safety of those areas.
I confirm that the minor is physically capable of riding a Bike and has no medical conditions that would prevent safe participation. I have disclosed any relevant medical conditions to Cyclerie, LLC.

Assumption of Risk
On behalf of myself and the minor, I knowingly and freely assume all risks associated with the test ride, both known and unknown, even if arising from the negligence of Cyclerie, LLC, its agents, members, or employees (collectively, “Releasees”), and I accept full responsibility for the minor’s participation.

Release and Waiver
In consideration for allowing the minor to participate in the test ride, I, for myself, the minor, and our respective heirs, assigns, and representatives, hereby release, waive, discharge, and agree not to sue Releasees from any and all liability for any claims, demands, losses, damages, or injuries, including personal injury, property damage, or wrongful death, arising out of or related to the minor’s test ride, whether caused by negligence of the Releasees or otherwise, including negligent rescue operations. I further agree that if, despite this waiver, I or anyone on my behalf makes a claim against any of the Releasees, I will indemnify and hold harmless each of the Releasees from litigation expenses, loss, liability, damage, or cost resulting from such claim.

Parental Consent
As the parent or legal guardian, I consent to the minor’s participation in the test ride, whether riding alone or with me on a cargo e-bike, and confirm my authority to enter into this agreement on the minor’s behalf. I understand that this waiver is binding in accordance with Colorado law.

Emergency Authorization
In the event of an emergency, I authorize Cyclerie, LLC to secure medical treatment for the minor if I cannot be reached at the time of the incident.

Governing Law
This agreement is governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising hereunder shall be resolved in the courts of Weld County, Colorado. If any portion of this agreement is held invalid, the balance shall continue in full force and effect.

Acknowledgment
I have read this waiver and release of liability, fully understand its terms, and sign it freely and voluntarily without any inducement. I understand that I am giving up substantial rights on behalf of myself and the minor by signing this document.
