I, {rentersName}, an adult aged 18 or older, hereby acknowledge and agree to the following terms to rent and operate a pedal-assist electric bicycle (“eBike”), traditional bicycle, or cargo bike (collectively, “Bike”) from Cyclerie, LLC for the rental period beginning on {startDate} and ending on {endDate}.

Acknowledgment of Risks
I understand that renting and operating a Bike involves inherent risks, including but not limited to falls, collisions, equipment failure, road hazards, traffic accidents, and other unforeseen incidents that may result in serious injury, disability, or death. I acknowledge that eBikes are motorized vehicles, heavier than traditional bicycles due to their battery and motor, and require skill and caution to operate safely. Cargo bikes may also handle differently due to their size and weight. My participation in renting and using the Bike is voluntary.

Safety Instructions and Compliance
I certify that a representative of Cyclerie, LLC has explained, and I understand, how to:

Operate the gears and brakes.
Operate the pedal-assist controls.
Operate the throttle-assist controls.

I agree to:

Wear a CPSC-approved bicycle helmet at all times during the rental period, as recommended for safe cycling and in compliance with Colorado law (C.R.S. § 42-4-1412 for minors, recommended for adults).
Start the ride with the pedal-assist mode set to off or zero (if equipped) and get accustomed to the Bike before using faster modes.
Ride only in areas permitted by Cyclerie, LLC and ensure the safety of those areas.
I confirm that I am physically capable of riding a Bike and have no medical conditions that would prevent safe operation during the rental period. I have disclosed any relevant medical conditions to Cyclerie, LLC.

Assumption of Risk
I knowingly and freely assume all risks associated with renting and using the Bike, both known and unknown, even if arising from the negligence of Cyclerie, LLC, its agents, members, or employees (collectively, “Releasees”), and I accept full responsibility for my participation.

Release and Waiver
In consideration for renting the Bike, I, for myself and my heirs, assigns, and representatives, hereby release, waive, discharge, and agree not to sue Releasees from any and all liability for any claims, demands, losses, damages, or injuries, including personal injury, property damage, or wrongful death, arising out of or related to my rental or use of the Bike, whether caused by negligence of the Releasees or otherwise, including negligent rescue operations. I further agree that if, despite this waiver, I or anyone on my behalf makes a claim against any of the Releasees, I will indemnify and hold harmless each of the Releasees from litigation expenses, loss, liability, damage, or cost resulting from such claim.

Equipment Responsibility
I agree to use the Bike in a careful and reasonable manner and return it to Cyclerie, LLC in the same condition as received, normal wear and tear excepted. I understand that I am responsible for any loss, theft, or damage to the Bike during the rental period and agree to cover the cost of repairs or replacement as determined by Cyclerie, LLC.

Emergency Authorization
In the event of an emergency, I authorize Cyclerie, LLC to secure medical treatment for me if I cannot be reached or am unable to consent at the time of the incident.

Governing Law
This agreement is governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising hereunder shall be resolved in the courts of Weld, Colorado. If any portion of this agreement is held invalid, the balance shall continue in full force and effect.

Acknowledgment
I certify that I am 18 years of age or older, have read this waiver and release of liability, fully understand its terms, and sign it freely and voluntarily without any inducement. I understand that I am giving up substantial rights by signing this document.
