AGREEMENT AND DISCLAIMER
INDEMNITY TO ALPINE SHIRE COUNCIL FROM THE ACQUIRER OF
UNTREATED MULCH
I, the undersigned, wish to acquire a quantity of untreated mulch from the Alpine Shire Council (“Council”).
I am aware that Council has no control over the contents of the vegetation that is deposited for mulching at Alpine Shire’s Transfer Stations.
I understand and appreciate that the vegetation that is deposited for mulching, and which I wish to acquire, does not meet industry standards for saleable mulch product and may contain chemicals, noxious weeds and pathogens. I therefore understand that the Council recommends that the mulch I wish to acquire only be used for non-primary production purposes.
Council does not provide any guarantees and accepts no liability for any loss or damage to property, any economic or consequential losses, any injury or death
of persons in connection with, or arising from, the supply, transport or use of this
organic material.
Council strongly recommends the use of Personal Protective Equipment when handling this material including heavy duty gloves, long sleeved shirt and pants, safety glasses and dust mask or other respiratory aids.
The recipient of the organic material has satisfied themself of the risks associated with the transport and use of the organic material and the need for adequate personal protection and controls and the suitability of the organic material for the intended purpose.
I also agree not to on-sell the mulch I wish to acquire. If I allow the mulch I acquire to be used by a third party or parties, I agree to warn them of the above risks I have been informed about within this form.
Indemnity and Hold Harmless
Upon acquiring the untreated mulch, I hereby undertake to indemnify and to keep indemnified the Council and or its servants and agents and also hold the Council harmless against and from all actions, claims, costs, charges, expenses and damages howsoever caused, arising out of the use of such mulch.
