  • 1. INDEMINIFICATION

    Participating vendors shall indemnify and hold harmless the Town of Chesapeake Beach and its officials, employees and agents from any and all liabilities, judgements, settlements, losses, costs or charges (including attorneys' fees) incurred by the Town of Chesapeake Beach or any of its officials, employees or agents as a result of any claim, demand, action or suit relating to any bodily injury (including death), loss or property damages caused by, arising out of, related to or associated with the use of the property or the participation of Community Partners or by the Community Partner's employees, agents or invitees in Town of Chesapeake Beach events for the year 2025.

    2. OPERATING REQUIREMENTS

    Community Partners are responsible for himself/herself and his/her employees, his/her subcontractors, materials, equipment, and all insurance to protect him/her and/or others.

    3. LOCATION

    All space assignments are final. The Town shall, in its sole discretion, have the final decision about how space is allocated. The Town reserves the right to change the Community Partner's space without notice or consent at any time.

    4. HOURS OF OPERATION

    Set up time starts one hour before each event unless approved by town personnel. Community Partners must be completely set up by the start of the event.

    5. SET-UP AND CLEAN-UP

    A. Community Partners are responsible for bringing your own tables, chairs, tablecloths, and plastic covers or something to keep your materials dry in case of rain.

    B. Tents or canopies may be used and must be secured for safety and to avoid injury or damage to property and/or patrons.

    C. Community Partners are required to make immediate safety changes when directed to do so by Town of Chesapeake Beach personnel.

    D. No disposal services will be provided by the Town. Trash receptacles are provided for park patrons but are not to be used by the Community Partners for the Community Partner's clean- up. The Town may charge and the Community Partner shall pay a fee for the actual costs, including staff time, incurred by Town as result of the Community Partner's failure to clean up as specified here.

    6. RESTRICTIONS

    A. No selling of items without prior permission from the Town.

    B. No electric will be provided, and generators are not allowed without advanced written permission from Savannah Richardson at the Town of Chesapeake Beach.

    7. VIDEO AND PHOTOGRAPHY RELEASE

    The Community Partner hereby grants to the Town the irrevocable and unlimited right and permission to use photographs and/or video recordings of the Community Partner, the Community Partner's intellectual property, and the Community Partner's property on the Town's social media accounts and website, publications, promotional flyers, marketing materials, derivative works, or for any other similar purpose without compensation or permission from the Community Partner. The Community Partner hereby releases, acquits, and forever discharges the Town from all claims, demands, rights, promises, damages, and/or liabilities arising out of or in connection with the use or distribution of said photographs and/or video recordings, including but not limited to any claims for invasion of privacy, appropriation, likeness, or defamation.

    8. NON-DISCRIMINATION

    The Community Partner and its employees shall not discriminate against any employee, patron, visitor, attendee or customer because of race, color, religion, sex, gender identity or expression, national origin, age, disability, familial status, marital status, sexual orientation, or other protected status.

    9. VIOLATIONS

    The Town may revoke Community Partner privileges for any activity that is found to be in violation of any ordinance, law or conditions of approval. In the event the Community Partner is not ready to vend at the designated time or if the Community Partner arrives in a condition that gives the appearance of being incapable of operating vending site in safe and commercially acceptable manner, the Community Partner shall be deemed to have violated these terms and the Town shall have the right, at its sole discretion, to revoke all privileges.
