1. LEASE TERM & RENTAL RATE:
- Monthly Rate: $100 per designated, lined, and numbered space.
- Lease Term: This is a month-to-month agreement unless otherwise agreed upon in writing.
- Payment Due: Rent is due on the 1st of each month and is considered late after the 14th of the
2. PAYMENT METHODS & LATE FEE POLICY:
- Accepted payment methods: Credit card, cash, or check.
- ALL CHECKS ARE PAID TO: MARIANNE GREEN
- Credit card payments incur a 3% processing fee
- If a credit card is declined at the time of payment, a $25 administrative fee will apply
- Late Fee: If payment is not received by NOON on the 14th, a 20% late fee will be applied to that
- If payment is not received by the 30th day, tenant's gate access will be revoked and may only be restored upon full payment of balance due, including any fees.
- Returned Checks: Any check returned for insufficient funds will incur a $30 bounced check fee. Tenant will be contacted and must resolve payment within 5 business days. If not resolved, the lease will be subject to immediate termination and access to the lot will be denied.
3. ACCESS, GATE CODE AND SECURITY POLICY
- The storage yard is monitored by 24-hour video surveillance; however, surveillance does not guarantee prevention of theft or damage.
- Access hours: Tenants may access the property 7 days a week, unless access is suspended due to non-payment.
- Gate Code Security:
- Each tenant will be able to pick a unique 4-digit gate code.
- Gate codes are strictly confidential. Do NOT share your code with any third party, including friends or family. Doing so increases the risk of theft, vandalism, and unauthorized access.
- Tenants are solely responsible for any damages or losses resulting from misuse or sharing of gate codes.
4. TENANT RESPONSIBILITIES & USE OF PREMISES:
- Only the item(s) listed on the lease may be stored in the assigned space.
- Tenants are responsible for securing and locking their property before leaving the premises-no exceptions.
- No on-site mechanical repairs, painting, habitation, or commercial activity is permitted.
- Stored property must be in good condition, free of fluid leaks, trash, and debris. Violations may result in cleaning fees and/or eviction.
- Dumping, abandoning, or improperly storing items will result in fines and/or legal action.
- No flammable, explosive, or hazardous materials may be stored on site.
5. LIABILITY AND INSURANCE:
- T&M Storage is NOT responsible for:
- Theft, vandalism, weather-related damage, fire, flooding, animal damage, or other loss of or damage to stored property.
- Any damage resulting from tenant negligence, gate code sharing, or acts of third parties.
- Tenants are strongly encouraged to carry their own insurance coverage for stored property.
- Tenant accepts full responsibility for securing and maintaining their vehicle or equipment.
6. DEFAULT, LIEN, AND REMOVAL OF PROPERTY:
- If payment is not made within 30 days of the due date, and attempts to collect have failed:
- Access will be revoked
- Per Colorado Revised Statutes § 38-21.5, the Owner may initiate lien proceedings to sell or dispose of stored property to recover unpaid charges.
- Tenant will be notified in writing prior to any such action as required by law.
- Continued non-payment or abandonment of property may result in removal from the premises at the tenant's expense.
7. TERMINATION OF LEASE:
- Either party may terminate the lease with 15 days' written notice.
- Upon termination, the tenant must remove all property from the lot. Property left behind will be treated as abandoned and disposed of accordingly.
- The Owner reserves the right to immediately terminate this lease in the event of:
- Gate code abuse
- Repeated late payments
- Storage of unauthorized or hazardous items
- Breach of any lease terms
8. TENANT ACHKNOWLEDGMENT & CONTACT INFORMATION:
By signing below, Tenant agrees to all terms and policies outlined in this agreement. Tenant acknowledges understanding that this lease is binding under Colorado law and grants T&M Storage the right to enforce these terms without further notice unless required by statute.
