Assumption of Risk and Release of Liability

Please read carefully.

This is a release of liability and waiver of legal rights.The person taking part in Boulder Nordic Team (BNT) activities shall be referred to herein after as "Participant".  The "Undersigned" means only the Participant when the Participant is age 18 or older OR it means both the Participant and the Participant’s parent or legal guardian when the Participant is under age of 18.The Undersigned, in consideration of participation in the Boulder Nordic Team, do hereby release and hold harmless the BOULDER NORDIC TEAM, it’s board members and officers, and all coaches, Boulder Nordic Team Board of Directors, parent volunteers, and other agents, employees, or contractors thereof, from any and all damages (including attorney’s fees and costs), liability, actions, claims, negligence, and/or personal injuries arising out of Participant’s participation in Boulder Nordic Team, events, including, but not limited to: training, ski racing, running, roller skiing, bike riding, dryland training activities, and travel to and from activities, accommodations while at skiing events, or any other activity associated with my participation in the Boulder Nordic Team.

The Undersigned expressly assume the risk of any injury to person or property resulting from any of the inherent dangers and risks of skiing and may not recover from Boulder Nordic Team, Eldora Mountain Resort, Boulder Nordic Club, and all coaches, parent volunteers, and other agents, employees, or contractors thereof, for any injury resulting from any of the inherent dangers and risks of skiing, including but not limited to: changing weather conditions; existing and changing snow conditions; bare spots; rocks; stumps; trees, collisions with natural objects, man-made objects, or other skiers; variations in terrain; and the failure of skiers to ski within their own ability.

Undersigned warrants and represents that the Participant is in good health, and there are no special instructions regarding the Participant that have not been listed below and on the annual team registration form.

In consideration of being allowed to participate in Boulder Nordic Team's program, related events and activities, and shared transportation, the Undersigned expressly acknowledges, appreciates, and agrees that participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19 and any variants thereof, influenza, and pneumonia.  While specific public health rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and the Undersigned knowingly and freely assumes all such risks, both known and unknown, even if arising from the negligence of others and assume full responsibility for participation in Boulder Nordic Team's program; and the Undersigned willingly agrees to comply with the states and customary terms and conditions for participation as regards protection against infectious diseases and acknowledges that it is the Undersigned's sole responsibility to safeguard the Participant and others; and the Undersigned, for him/herself and on behalf of his/her heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless Boulder Nordic Team, its Board of Directors and officers, all coaches, parents volunteers, agents, independent contractors, and other participants, with respect to any and all illness, disability, death, or loss or damage to person or property, to the fullest extent permitted by law.  

Undersigned has and agrees to maintain valid and sufficient medical and accident insurance for the Participant throughout the time that the Participant participates in any club activities.  The Undersigned understands that this insurance is his/her sole responsibility, and RELEASES the team from any claim and/or responsibility for providing such insurance coverage for the Participant.Undersigned authorizes the team where Participant may participate in a Club activity and their authorized personnel to obtain medical care for the Participant or to transport the Participant to a medical facility or hospital if, in the opinion of such personnel, medical attention is needed.

The Undersigned hereby completely releases and holds harmless the team and their representatives, officers, directors, coaches, and volunteers (collectively the released parties) from any and all claims of any nature or any kind for injury, or death to Participant or Participant’s property that may be sustained in connection with team activity, including any injury, death, or damage that results from negligence of the released parties.  In consideration of engaging in team activities, the Undersigned agrees that all claims for injury and/or death for shall be governed by the law of the state of Colorado.

This agreement shall be binding to the fullest extent permitted by law.  If any provision of this agreement is found to be unenforceable, the remaining terms shall be enforceable.  The Undersigned acknowledges that he/she is signing this agreement on behalf of him/herself or on behalf of a Participant who is a minor, and that Participant is bound by all the terms of this agreement.  This agreement shall be binding upon the Participant’s assignees, subrogers, distributors, heirs, next of kin, executors and personal representatives.

BNT Van Disclaimer

All BNT members and visitors must sign this waiver regardless of intent to ride the van.

The National Transportation Safety Board has issued warnings about 15 passenger vans. They can lose control in emergency handling situations more than other vehicles when full. We have evaluated other transportation alternatives and none meets our needs. We have done several things to address the situation:

1) We try not to put 15 people in the van.

2) We put as little weight on top as possible (only ski bags in aerodynamic carrier boxes).

3) Van drivers are limited in number and have been informed of safety issues.

4) We pay our Head Coach, the primary Driver, a year-end bonus for safe driving.

5) We have studded winter tires.

6) Drivers remind kids to put on seat belts.

7) We have driven this type of vehicles for many years on these same roads and never had an accident.

All this said, the van travels winter conditions on mountain roads on a regular basis. If you do not feel comfortable with the safety of the van, do not put your kids on it.

SIGNATURE OF PARENT/GUARDIAN REQUIRED FOR PARTICIPANTS UNDER THE AGE OF 18

As the parent or guardian of the minor child participant named above, I hereby make and enter into each and every agreement, representation, waiver and release described above on behalf of myself, the participant, and any other parent or guardian of the participant, intending that they be binding on me, the participant, and our respective heirs, executors, administrators and assigns. By affixing my signature below I represent that I intend to give up my right, the right of the participant, and the right of any other parent or guardian to maintain any claim or suit against Boulder Nordic Team, its Board of Directors and Officers, all coaches, parents, volunteers, agents, independent contractors, and other participants arising out of the participant's participation in any Activities involving Boulder Nordic Team in any way. I further agree to hold harmless, defend, and indemnify Boulder Nordic Team, its Board of Directors and Officers, all coaches, parents, volunteers, agents, independent contractors, and other participants of and from any claims from third parties arising from the minor child participants’ participation in any activities affiliated with Boulder Nordic Team.
