Term and conditions
By booking a delivery through a Tommy Sugo Delivery Partner, you agree to the following terms and conditions.
1. Our Role
1.1 Tommy Sugo provides access to courier and freight services through trusted delivery partners. We have arranged preferential service terms with these partners, which we extend to our customers (“Services”).
1.2 We operate as a reseller of these Services and may engage one or more independent carriers (“Courier Partners”) to carry out deliveries.
1.3 While we manage your account, bookings, and payments, the physical transport of goods is carried out by Courier Partners.
2. Pricing and Payment
2.1 All prices quoted are Tommy Sugo’s own service rates.
2.2 Payments are made directly to Tommy Sugo not to the Courier Partners.
2.3 Once payment is received, we arrange delivery with an appropriate Courier Partner.
3. Liability for Delivery
3.1 Courier Partners are solely responsible for the safe transport, handling, and delivery of goods.
3.2 Tommy Sugo is not liable for loss, damage, delay, or non-delivery of goods once in the possession of a Courier Partner.
3.3 Claims relating to delivery issues will be managed in line with the Courier Partner’s terms of service. (Download Terms & Conditions)
4. Customer Responsibilities
4.1 Customers must provide accurate weights, dimensions, packaging, and any special handling requirements for consignments.
4.2 The delivery may be rejected at any time prior to pick up for any reason (with the payment refunded if no costs have been incurred). Additional charges may apply if goods are inaccurately declared or require special handling (e.g., tail-lift, oversized items, dangerous goods).
5. Insurance
5.1 Unless otherwise agreed in writing, insurance for goods in transit is the sole responsibility of the customer.
5.2 We strongly recommend customers arrange appropriate cover prior to booking.
6. Governing Law
These Terms are governed by the laws of Western Australia.
7. Waiver of Liability
7.1 Tommy Sugo is not the carrier and does not assume responsibility for the transport of goods.
7.2 I release and discharge Tommy Sugo from any liability for loss, damage, or delay of goods while in transit.
7.3 I understand that all goods are carried entirely at my own risk unless I have arranged separate insurance.
