This agreement is entered into between Whisker’s Way Animal Rescue (“Whisker’s Way”) and the undersigned Foster Caregiver.
Ownership of Animal
1. The foster caregiver understands and agrees that all foster animals remain the sole legal property of Whisker’s Way at all times.
2. This agreement does not transfer ownership or legal rights to the foster caregiver.
3. Whisker’s Way reserves the right to remove or relocate the animal at any time, with or without notice.
Foster Care Responsibilities
4. The foster agrees to provide safe and humane care including proper food, water, shelter, exercise, supervision, and enrichment.
5. The foster agrees the animal will not be:
rehomed
transferred
given away
surrendered
bred
used for guarding, fighting, or illegal purposes
without written permission from Whisker’s Way.
6. The foster agrees to comply with all local animal control laws.
7. The foster must immediately notify Whisker’s Way of:
illness or injury
escape or loss
bite incidents
aggressive behavior
change in living situation
Veterinary Care
8. Veterinary care must be pre-approved by Whisker’s Way except in life-threatening emergencies.
9. Unauthorized veterinary expenses may become the responsibility of the foster.
Assumption of Risk
10. The foster understands animals are unpredictable and may cause:
bites or scratches
zoonotic illness
injury to people or animals
property damage
The foster voluntarily assumes all risks related to the animal.
Liability Release & Indemnification
11. The foster agrees to release, waive, and hold harmless Whisker’s Way, its board members, officers, volunteers, and representatives from any and all claims, damages, injuries, losses, or legal actions arising from the animal while in foster care.
12. The foster agrees to indemnify and defend Whisker’s Way against any legal claim involving:
dog bites or animal attacks
property damage
ordinance violations
injury or death
medical or veterinary expenses
Insurance Acknowledgment
13. The foster acknowledges they are solely responsible for maintaining adequate renter’s or homeowner’s insurance.
14. Whisker’s Way provides no insurance coverage for foster caregivers.
Return of Foster Animal
15. The foster agrees to return the animal:
upon request by Whisker’s Way
if unable to continue fostering
at scheduled adoption events or vet appointments
The foster may not independently place the animal.
No Guarantee Clause
16. The foster acknowledges that Whisker’s Way makes no guarantees regarding temperament, behavior, health, or adoptability of the animal.
Governing Law
17. This agreement shall be governed by the laws of the State of Arizona.
