This Agreement applies to any individual accessing the Premises or participating in Activities in any capacity, including but not limited to, as a participant, volunteer, guest, independent contractor, or instructor. II. Activities. Nature of Premises & Definitions

You wish to enter and participate in activities at Free Spirit Stables including without limitation: interacting with or working around horses and other animals; care, handling, training, riding, dancing, and yoga with horses; meditation or mindfulness sessions; ranch chores such as mucking, feeding, grooming, tack handling; trail walking; vehicle/equipment access or use; landscaping and gardening; repairing or maintenance of Free Spirit Stables Property, and other educational, exercise, wellness, and volunteer experiences. Activities may vary widely and include tasks of different physical and mental demands. "Free Spirit Stables Property" means all land, improvements, structures, fencing, arenas, trails, sheds/coops/barns, tools, implements, equipment, vehicles, and animals (including horses, dogs, and cats).
III. Safety Rules & Participation Conditions

Follow all Free Spirit Stables rules and instructions for your safety and that of others. This includes all posted signage and any rules communicated by Free Spirit Stables staff. Rules may be updated periodically, and compliance with the most current version is required for continued participation. No outside animals may be brought onto the Premises without prior written consent from Hannah Francis and Free Spirit Stables. Health & Fitness: You represent that you are physically and mentally able to participate in the Activities; you will disclose any conditions that could affect safe participation in the Activities; you will not participate in the Activities under the influence of alcohol, cannabis, or impairing medication. Terrain, Plants & Insects: The Premises includes uneven/open terrain, poison oak and other plants, and insects such as bees/wasps/spiders; exposure may cause injury or allergic reactions, which can be severe. Vehicles/Equipment: Any access to (or use of) vehicles or equipment is at your own risk; you will use only as authorized.
IV. Assumption of Risks

I the Releasing Party, hereby acknowledge that I have voluntarily applied to participate in instruction in the care, handling, training, riding, dancing, and yoga with horses by Hannah Francis and Free Spirit Stables. I am aware that activities involving horses can be hazardous, and I am voluntarily participating in these activities with knowledge of the danger involved and hereby agree to accept any and all risks of injury or death.

1. I wish to participate in instruction with Hannah Francis and Free Spirit Stables and hereby assume all risks of engaging in said instruction. I represent and warrant that I am in good physical health and do not suffer from any medical condition(s) that would limit my participation in the classes offered by Hannah Francis and Free Spirit Stables. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in any of the yoga or dance classes offered by Hannah Francis and Free Spirit Stables. I understand the risks associated with the activities offered by Hannah Francis and Free Spirit Stables and I agree to follow all instructions so that I can safely participate in these classes involving horses. I also hereby hold harmless and release Free Spirit Stables, any associates, as well as Hannah Francis in her individual capacity, and indemnify each of them from and against any and all loss, claim, cause of action, lawsuit, damage, liability, cost or expense whatsoever which any of them may incur arising out of or in connection with my participation in said instruction with Free Spirit Stables, including but not limited to the care, handling, training, riding, dancing, and yoga with horses; meals, food and beverages served; and the use of any equipment and facilities at Free Spirit Stables.
2. I acknowledge that participation in yoga classes, dance classes, or any other fitness exercise classes with horses exposes me to possible risks of personal injury. I am fully aware of these risks and hereby release Hannah Francis and Free Spirit Stables, and/or any other persons who may teach with Free Spirit Stables from any and all liability, negligence, or other claims arising from, or in any way connected with my participation in their yoga classes, dance classes, and any other exercise classes with horses offered by them.
3. I hereby certify that I am at least 18 years of age (or, if less than 18 years of age, have caused this Release and Waiver of Liability and Indemnity Agreement to be signed by my parent or legal guardian), I agree that neither I nor any member of my family will sue any Indemnitee for injury, death or damage resulting from the negligence or other acts, howsoever caused, of Hannah Francis and Free Spirit Stables or of any employee, assistant, helper, agent or contractor of Hannah Francis and Free Spirit Stables, as a result of my participation in said instruction. I understand that this Release and Waiver of Liability and Indemnity Agreement shall be binding upon my estate, my heirs, next of kin, executors, administrators, representatives, successors, and assigns. I specifically waive any claim or right to assert any cause of action or alleged cause of action or claim or demand which has, through oversight or error, intentionally or unintentionally, or through a mutual mistake, been omitted from this Release and Waiver of Liability and Indemnity Agreement.
4. I hereby agree to indemnify and hold harmless Hannah Francis and Free Spirit Stables or any employee, assistant, helper, agent, or contractor of Hannah Francis and Free Spirit Stables from any loss, liability, damage, or cost that may be incurred due to my participation in said instruction and training, whether caused by the negligence of Hannah Francis and Free Spirit Stables or otherwise.
5. I hereby assume full responsibility for any risk of bodily injury, death, or property damage due to the negligence or other acts, however caused, of Hannah Francis and Free Spirit Stables or of any employee, assistant, helper, agent, or contractor of Hannah Francis and Free Spirit Stables resulting from my participation in said instruction
V. Media Release

I grant Hannah Francis and Free Spirit Stables a royalty-free, perpetual, worldwide license to use photos/video/audio of me taken in connection with care, handling, training, riding, dancing, and yoga with horses, for communications, education, and promotions, in any medium now known or later developed, without review or compensation. I waive any right to royalties, future claims, or approval of use, and release Hannah Francis and Free Spirit Stables from liability for invasion of privacy, defamation, or misappropriation related to such use, to the fullest extent permitted by law.
VII. Governing Law; Amendment; Interpretation of Agreement

This Release and Waiver of Liability and Indemnity Agreement shall be governed by the laws of the State of California, and that any action, claim, or proceeding under this Release and Waiver of Liability and Indemnity Agreement shall be commenced exclusively in the courts of California or the United States District Court for the Northern District of California. This Release and Waiver of Liability and Indemnity Agreement may not be revoked, terminated, or amended verbally, but only by a written instrument signed by me and an authorized representative of Hannah Francis and Free Spirit Stables. All covenants contained herein are severable, and in the event of any being held invalid by any competent court, this Agreement shall remain intact except for the omission of the invalid covenant.
V. Acknowledgment

By signing below (including by electronic signature), I acknowledge that I have read and understood this Release and Waiver of Liability and Indemnity Agreement, and fully understand its contents and sign it of my own free will. I am aware that by signing this Release and Waiver of Liability and Indemnity Agreement I am waiving certain leagal rights which I or members of my family, my heirs, next of kin, executors, administrators, representatives, successors, and assigns may have against Hannah Francis and Free Spirit Stables or any employee, assistant, helper, agent, or contractor of Hannah Francis and Free Spirit Stables.
I expressly acknowledge and agree that any activities involving horses are very dangerous, and involve the risk of serious injury and/or death and/or property damage. I further agree that the foregoing Release and Waiver of Liability and Indemnity Agreement is intended to be as broad and inclusive as is permitted by the laws of the state of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
