  • By signing this form, I authorize the American Academy of Orthopaedic Surgeons (AAOS) and anyone acting under its authority to record my name, likeness, voice or image in all forms and media and in all manners (collectively "the Recorded Image").

    I understand that I am giving AAOS permission for the reproduction, sale, advertisement, broadcast, exhibition and/or distribution of the Recorded Image including any reproductions made by any process, in any format, alone or in conjunction with other persons, or based on any additions, alterations, retouching or compositing with other reproductions of any kind. Further, I give up all rights of inspection or approval of the Recorded Image and irrevocably release all claims or demands which I may or can have on account of the use or publication of the Recorded Image.

    I understand that the AAOS owns all intellectual and/or property rights to any and all products developed which include the Recorded Image and that AAOS is not obligated to use the Recorded Image.

  • Documentation of FDA Status for Uses Described

  • Academy policy provides that "off label" uses for prescription drugs, biologics, and approved medical devices means any use that is not specified in the labeling approved by the U.S. Food and Drug Administration (FDA). For cleared medical devices, "off-label" means any use that is not included in the cleared "indications for use." Labeling is considered any written material which accompanies, supplements, or explains the product. For more information, see the Academy Position Statement on Off-Label Use of Medical Products.

  • I have created and am the current copyright holder of materials (including work(s), illustration(s), text, image(s) or other creative material(s) that I am providing for the above titled session, which is hereinafter referred to as the "Work". I agree to license the Work to the American Academy of Orthopaedic Surgeons (collectively, "AAOS") according to the following terms:

    1. I hereby grant the AAOS a non-exclusive perpetual license to publish, copy, reproduce, prepare derivative works based on, distribute, transmit, communicate, perform and display of the Work anywhere in the world and in any format. The AAOS is not obligated to use the Work in any way.
    2. I am giving this license to the AAOS as a contribution. I specifically release the AAOS from any obligation to pay money or otherwise perform services for this license.
    3. The AAOS may use the Work for educational purposes only. I understand and agree that these purposes include, but are not limited to, the sale, sublicense, advertisement, of the Work or any portion thereof, printing, translation, exhibition, broadcast, Internet use, and distribution solely or in combination with other material.
    4. I declare that the Work does not infringe any copyright, violate any property rights (including other intellectual property rights such as trademark, trade secret, or patient rights), or contain any scandalous, libelous or unlawful matter. With respect to any part of the Work that I do not own, I warrant that appropriate consents (consistent with the terms and conditions of this Release) from the copyright holder have been obtained and I will provide them to AAOS upon request.
      I hereby release, discharge and agree to save harmless and indemnify AAOS, its affiliates, employees, directors, officers, representatives, agents, successors, and/or assigns, (individually and collectively, "AAOS"), from and against any and all whatsoever, and all reasonable attorneys' fees and other expenses relating to its defense from any claim, suit or action brought against AAOS due to copyright infringement, libel, slander, invasion or privacy or any other claim whatsoever based on any use of the Work.
    5. If the Work contains any patient-identifiable information, I warrant that I have obtained all necessary permissions and/or have adhered to all requirements under state and federal privacy laws and regulations (including the HIPAA privacy regulations).

  • Faculty Waiver of Liability

  • I agree to waive any claim I may have against the American Academy of Orthopaedic Surgeons ("AAOS"), its empoloyees, agents, or representatives, for any damage, injury or disease arising from the undersigned's participation and attendance at the AAOS educational course for which the undersigned is participating in.

    I fully understand and expressly assume any risk associated with my attendance and participation in this AAOS educational course that will involve exposure to and possible contact with cadaveric specimens, for which no medical history is available, and medical equipment, such as power saws.

    In addition to the waiver, the policy mandates that every individual must wear the protective wear provided by AAOS during the lab sessions in order to participate in the course.
