  • RIGHT OF INTERNMENT IN A COLUMBARIUM NICHE

    THIS RIGHT OF INTERNMENT AGREEMENT, hereinafter referred to as "Agreement", made and entered into this _____day of __________________, 20____, by and between St. Philip the Apostle Catholic Church of Flower Mound, Texas hereinafter referred to as "Church" and ______________________________________, hereinafter referred to as "Purchaser."

    WITNESSETH:

    WHEREAS, the Church has established a plot of land known as the St. Philip the Apostle Columbarium;

    WHEREAS, the Church has also established its Policy Governing the use of the Columbarium, which is attached hereto and is incorporated as if fully set forth herein;                                         

    WHEREAS, the Policy may be amended and revised in the future, at the Church's sole discretion, and the Purchaser agrees and accepts the Church's right to do so;                  

    WHEREAS, foregoing premised considered, the Purchaser desires to enter into this Agreement to obtain permission to utilize a burial niche in the Church's Columbarium and to pay the agreed consideration;  

    NOW THEREFORE, IN CONSIDERATION of $___________ paid to the Church by the Purchaser, the Church and the Purchaser agree and covenant as follows: 

    1. The Church agrees to provide a burial niche # ________ in the St. Philip the Apostle Columbarium for cremated remains. The niche may hold a maximum of two urns. 

    2. The burial niche which is the subject of this Agreement shall be used for interment of the ashes of (Names/information about the individual(s) the Niche is purchased for):

  • 3.  The Purchaser agrees to purchase an urn (hereinafter "standard urn") acceptable to the Church for use in the niche. The urn must meet the size restrictions as set forth by the Parish. The standard urn must be engraved (only) with the name of the deceased, birth and death dates. An urn must be purchased for each cremated remains. The Purchaser will be responsible for the cost of the urn and engraving plus applicable taxes.  

    4. The Bishop of the Roman Catholic Diocese of Fort Worth, Texas, as beneficial owner, shall retain to the Columbarium and grants to Purchaser the right of interment to use the niche in accordance with the Policy Governing the Use of the Columbarium. It is expressly understood this Agreement does not constitute a sale of property rights but is merely the providing of a niche space for Interment in accordance with the existing use Policy.  

    5. The rights of the Purchaser to transfer a burial niche are restricted. See Policy, Section 3, for details. Any unauthorized transfer of a niche (whether by sale, gift or inheritance) shall be void, and may cause the right of Interment to revert back to St. Philip the Apostle Catholic Church.  

    6. By signing the Agreement, the Purchaser represents a legal right to the remains of the person to be placed in a niche and the authority to execute this Agreement in that capacity. The Church assumes no responsibility to inquire further as to next of kin, or into the authority of the person executing this Agreement, and the Purchaser releases and holds harmless the Church from such inquiry, and agrees to indemnify the Church if the representation is contested and the Church incurs expenses.  

    7. This Agreement, and the attached Policy, replaces all other discussions and oral agreements relating to the Columbarium and the right of Interment in a niche. No subsequent discussion or agreement can change the terms of this Agreement unless it is written and it is signed by both the Purchaser and the Church. 

    IN WITNESS WHEREOF, this Right of Internment Agreement has been executed by all parties on the date first written above.
