I hereby acknowledge that I have voluntarily chosen to participate in events, activities, and other programs (collectively, the “Activities”) at Camp Bow-Isle (the “Camp”).
Assumption of Risk. I recognize that the program and its activities involve risk of injury and I agree to accept risks associated with it, including but not limited to property damage or loss, minor bodily injury, drowning, hypothermia, dehydration, burns, travel to and from programs, limited availability of medical assistance, the possible reckless conduct of other participants, severe bodily injury, and death.
Release from Liability. I hereby (1) agree to assume full responsibility for any and all injuries or damages which are sustained, aggravated or caused by myself, or anyone else, in relation to the Activities and the facilities, and (2) agree to waive and release any and all claims which I have or may have in the future against the Camp, its affiliates, and their respective directors, officers, employees, agents, representatives, shareholders, contractors, successors, and assigns (“Releasees”), arising from participating in or attending the Activities or attending or using the Facilities, for any injury, temporary or permanent disability, death, property damage, damages, liabilities, expenses, costs, and/or causes of action, now known or hereinafter known in any jurisdiction in the world, whether caused by the negligence of the Camp, the Releasees, or by any other reason. I acknowledge and agree that this Acknowledgement and Agreement is a complete release of any responsibility of the Camp and the Releasees for any injury, temporary or permanent disability, death, damages, liabilities, expenses, costs, and/or causes of action sustained by myself while participating in or attending the Activities or attending or using the facilities.
Indemnification. In consideration of my participation, I agree to indemnify, defend, and hold harmless Camp Bow-Isle, its elected and appointed officials, employees, agents, volunteers, and assigns from and against all claims arising out of, or resulting from my participation in the program. “Claim” as used in this agreement means any financial loss, claim, suit, action, damage, or expense, including but not limited to legal fees, attributable to bodily injury, sickness, disease or death, or injury to or destruction of tangible property including loss of use resulting therefrom, and any and all claims, both present and future, that may be made by me, my family, estate, heirs, or assigns.
Participant’s Representations. I acknowledge and represent that:
a) I am capable of participating in the Activities;
b) I understand that participating in the Activities constitute strenuous physical activity, and that I am in good health and is able to engage in such activity;
c) I have no medical or physical condition that would prevent me from properly participating in the Activities or using the Facilities, or would put myself or anyone else in physical or medical danger;
d) I have not been instructed by a physician to not participate in physical exercise or in the type of physical exertion required by the Activities;
e) I am physically and mentally capable of participating in the Activities and using the facilitates at the Camp;
f) I will at all times wear appropriate footwear while participating in the Activities;
g) I shall at all times follow all the rules and regulations for the Activities and of the Facilities, as may be established or modified by the Camp from time to time;
h) I will at all times comply with all stated and customary terms, posted safety signs, rules, written direction, and verbal instructions given to me by the Camp;
i) I agree and understand that the Camp has the right to deny any person access to the Camp’s facilities if it deems that person to be acting in an inappropriate or unsafe manner;
j) I have been informed about the Activities in which I will be involved;
k) I will not consume or be under the influence of any alcohol or recreational or illicit drugs when participating in the Activities;
l) if I have any chronic disabilities or conditions, I understand and acknowledge that I am at risk by participating in the Activities and using the facilities and should not be participating in the Activities or using the facilities;
m) I acknowledge that I am signing this document freely and voluntarily, and that the term of this document is indefinite;
n) I acknowledge that I have been given the opportunity to seek independent legal advice before signing this agreement, and have obtained such advice or have voluntarily chosen not to;
o) I acknowledge this document binds me, and my heirs, next of kin, executors, personal representatives, and assigns; and
p) I have fully read and understand each of the provisions of this Acknowledgement and Agreement and acknowledge that I am voluntarily waiving substantial legal rights, including the right to sue the Camp and the Releasees.
Insurance. I also understand that Camp Bow-Isle does not provide any medical or dental insurance or life insurance to cover bodily injury, illness, or death, nor insurance for personal property damage or loss, nor insurance for liability arising out of my negligent acts or omissions; and I acknowledge that I am completely responsible for my own insurance to cover these expenses.
Valuables and Personal Property. I acknowledge that I have been urged to avoid bringing valuables onto facilities and that the Camp shall not be liable for the loss of, theft of, or damage to my personal property, including items left in the cabins, lodge, bathrooms, or anywhere else in the facilities and camp property. I acknowledge that no portion of any fees paid by myself is in consideration for the safeguarding of valuables.
Entire Agreement. This Acknowledgement and Agreement is the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior agreement or communications between the parties, whether written, oral, electronic, or otherwise. Except as expressly provided in this Acknowledgement and Agreement, there are no representations, warranties, conditions, other agreements, or acknowledgements, whether direct or collateral, express or implied, that form part of or affect this Acknowledgement and Agreement.
Governing Law. I acknowledge that this agreement and any rights, duties, and obligations as between the parties to this agreement will be governed by and interpreted solely in accordance with the laws of the Province of British Columbia. Furthermore, any litigation involving the parties to this agreement must be brought within the Province of British Columbia and the parties' lawyers to the exclusive jurisdiction of the Courts of the Province of British Columbia.
Severability. If any term or provision, or any portion of a provision, of this Acknowledgement and Agreement is held to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Acknowledgement and Agreement.
I agree that this acknowledgment of risk and hold harmless is effective for as long as I participate in the program. I have read and understand this acknowledgment of risk and hold harmless form.
I {customerName} AGREE THAT THIS ACKNOWLEDGEMENT OF RISK AND HOLD HARMLESS AGREEMENT IS EFFECTIVE FOR AS LONG AS I PARTICIPATE IN THE PROGRAM. I HAVE READ AND UNDERSTAND THIS ACKNOWLEDGEMENT OF RISK AND HOLD HARMLESS FORM.
