I consent for the participant to participate in classes, activities, performances, and events with the Otto M. Budig Academy of Cincinnati Ballet (the "Academy"). I understand dance training at the Academy requires sustained, repetitive, vigorous physical activity, usually performed on a wood floor or lightly padded surface without protective footwear (i.e. athletic shoes). I also understand dance instruction involves tactile cueing and corrections which may include physically touching as part of regular classwork and rehearsals. I acknowledge there are inherent risks of serious injury in all the above activities as well as in the general participation of Academy activities and events. I further consent for the participant to attend and participate in online classes during a temporary transition to distance learning. I understand engagement in dance training at home may present risks not known or not reasonably foreseeable to Cincinnati Ballet and it is my responsibility to inspect the facilities and equipment to be used and I assume all risk in connection to the participant’s dance training at home or any other location they may choose. I further understand in-studio classes may be shared via video feed with students learning remotely and online classes may be recorded and shared with other enrolled students for the express purpose of continuity of instruction. I shall indemnify, hold harmless and defend Cincinnati Ballet, including its employees, agents and trustees (the "Cincinnati Ballet") against any and all claims, actions or suits brought for damages or alleged damages, and from all liability, loss and expense, including reasonable legal expenses, resulting from any injury to person or property or from loss of life sustained by the participant while participating in classes, rehearsals, performances and activities on the premises of Cincinnati Ballet’s Otto M. Budig Academy and all other venues where Academy activities may take place. I understand the participant is responsible for maintaining control over all personal items and agree I shall not hold Cincinnati Ballet liable for the loss or theft of the participant’s personal items.

I understand Cincinnati Ballet maintains certain health and safety guidelines for the benefit of all participating students, staff and faculty and that compliance is a requirement of participation. I further understand Cincinnati Ballet will offer ample notice of their safety protocols in order for the participant to adequately prepare to comply.

I declare I have either consulted a physician or voluntarily chosen not to consult a physician regarding the participant’s health before the course of the program. I have been warned the participant must be in sufficient health to participate in the program and now declare the participant is in sufficient health. In the event non-emergency medical attention is required for a minor while attending a Cincinnati Ballet class, activity, performance, and/or event, the minor’s parents or guardians will be contacted. If the parent or guardian cannot be reached, I authorize Cincinnati Ballet to arrange for the participant’s treatment as necessary, at my expense. In the event emergency/urgent care is required while attending a Cincinnati Ballet class, activity, performance, and/or event, Cincinnati Ballet and its employees and representatives are hereby authorized as the agent for the participant to consent to emergency medical or dental care on their behalf, including x-ray, MRI, and other diagnostic imaging examination, anesthetic, dental, medical, or surgical diagnosis or treatment, or hospital care under the supervision and upon the advice of a licensed physician or dentist. In such event, Cincinnati Ballet is authorized to submit to the treating facility the medical information set forth on the registration form. I understand I am solely responsible for any medical, health or personal injury costs resulting from the participant’s participation in Cincinnati Ballet and Academy activities.

I hereby give to Cincinnati Ballet, its legal representatives and assigns, those for whom Cincinnati Ballet is acting, their media and partner organizations, and those acting with their authority, the permission to record and use in any medium the participant’s image and/or sound and give all rights to the sound, still, or moving images to Cincinnati Ballet. I further give the unrestricted right and permission to copyright, use, and publish the participant’s image and/or sound in which they may be included intact or in part in conjunction with their own or a fictitious name for promotion, advertising, or any other purpose whatsoever. I also permit the use of any printed material in connection therewith. I hereby relinquish any right I may have to examine or approve the completed product or products or the advertising copy or printed matter that may be used in conjunction therewith or the use to which it may be applied. I hereby release, discharge and agree to hold harmless Cincinnati Ballet, its legal representatives or assigns, and all persons functioning under their permission or authority, or those for whom they are functioning, from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use, that may occur or be produced in the taking of said picture or in any subsequent processing or publication thereof, including without limitation any claims for libel or invasion of privacy. I consent to the use of the participant’s sound, still or moving images in all other purposes not explicitly mentioned herewith.
