• 141 Wardour Street Liability Waiver & Par-Q Declaration

  • Applicable to all participants of fitness classes, personal training sessions, and users of the gym at 141 Wardour Street.

     


    1. Physical Activity Readiness Questionnaire (PAR-Q)


    This form helps determine if you should consult your GP before becoming physically active. Please answer the following questions honestly and consult a medical professional if needed.

    If you answer ‘Yes’ to any of the questions below, you must seek medical clearance before participating in any fitness activity and contact us at hello@thatday.uk.

    PAR-Q Questions:

    • Has your doctor ever said you have a heart condition or cardiovascular disease?
    • Do you experience chest pain during physical activity?
    • Have you had chest pain when not doing physical activity?
    • Do you lose your balance due to dizziness, or ever lose consciousness?
    • Has your doctor ever said you have high blood pressure?
    • Do you have a bone or joint problem that could be made worse by physical activity?
    • Are you pregnant or have you been in the past 6 months?
    • Do you suffer from lower back problems, such as chronic pain or numbness?
    • Are you currently taking any medication for a medical condition?
    • Do you have a disability or communicable disease?
    • Is there any other reason why you should not take part in physical activity?


    By continuing, you confirm that all answers are ‘No’. If any answer is ‘Yes’, you must obtain medical clearance before participating.


    2. Assumption of Risk and Liability Waiver

    By participating in any That Day class, personal training session, or by accessing the gym facilities (the “Facilities”) at 141 Wardour Street, you acknowledge and agree to the following:

    • You are voluntarily participating in physical activity and assume full responsibility for any risk of injury, illness, or other issues that may result.
    • You understand that activities may include, but are not limited to, cardiovascular training, resistance training, stretching, and use of various equipment.
    • You acknowledge that physical activity involves inherent risks, including but not limited to muscle strain, joint pain, injury, heart attack, stroke, or even death.
    • You confirm that you are in good health, have disclosed all relevant medical conditions, and have been advised to consult your GP before beginning any exercise programme.
    • You accept that all instructions, demonstrations or advice provided (whether in-person, online or written) are general guidance only and not a substitute for medical advice.
    • You are responsible for exercising within your own limits, listening to your body, staying hydrated, and resting when needed.
    • You must inform the instructor of any medical conditions or injuries, and if you feel unwell, unsafe, or unsure during any session, you must inform the instructor immediately and stop exercising.


    3. Use of Gym Facilities – Known Hazards

    While every effort has been made to ensure the gym is a safe environment, you acknowledge the presence of potential hazards, including but not limited to:

    • Reduced lighting in certain areas
    • Low ceilings or fixtures where there is a risk of head injury


    By using the Facilities, you agree to take care when moving through the space, and ensure all equipment is used and stored safely. You are responsible for checking equipment before use and must not leave equipment in positions that could pose a risk to yourself or others.


    4. Equipment Use & Induction

    You agree that:

    • You will not use any equipment unless you fully understand how to use it safely.
    • If you are unsure how to use any equipment, you will seek guidance from a That Day team member or refrain from using it.
    • You will not attempt exercises or use machines that feel unsafe or unfamiliar.
    • You will report any faulty or unsafe equipment to a member of the That Day team immediately.
    • Where a gym induction is offered or required, you will ensure it has been completed before using the Facilities.



    5. Release of Liability

    You hereby release, waive, and discharge That Day, its employees, trainers, contractors, representatives, and the Landlord and its agents from all liability, claims, demands, or causes of action arising out of or related to any injury, illness, or loss that may occur through participation in any activity or use of the Facilities, except in cases of gross negligence or wilful misconduct.

    You understand and accept that you are participating entirely at your own risk.


    6. Acceptance & Consent


    By purchasing a session, package, or membership, or by attending a class or using the Facilities, whether in person or via our app or website, you confirm that you:

    • Have read and understood this Liability Waiver and PAR-Q
    • Are aged 18 or over, or have obtained consent from a parent/guardian
    • Accept full responsibility for your health and safety
    • Consent to participate at your own risk


    If you do not agree to the above, you must not participate or use the Facilities.
