WAIVER - ON CAMPUS EVENT

RELEASE OF LIABILITY, WAIVER OF ALL POSSIBLE CLAIMS, ASSUMPTION OF RISK

Please Read Carefully As It Affects Your Legal Rights

To: Students' Association of Mount Royal University (SAMRU)

I, on my own behalf or as the legal guardian(s) of my child (the "Minor"), hereby acknowledge and agree to the terms and conditions set forth by SAMRU for my participation in its activities and events.

I desire to participate in the above event/ activity sponsored, organized, or approved by SAMRU (the "SAMRU Activity") that may take place on the SAMRU premises or Mount Royal University (MRU) premises. I understand that in order to participate in the SAMRU Activity, I must agree to be bound by this Release, Waiver and Assumption of Risk.

In consideration of SAMRU accepting this form and permitting the individual named below to participate in the SAMRU Activity, and for other good and valuable consideration, I agree to all the terms and conditions set forth in this Release, Waiver and Assumption of Risk (the "Agreement").

 

Assumption of Risk

I acknowledge and understand that participating in the SAMRU Activity involves certain risks, dangers, and hazards, including but not limited to the risk of physical injury, death, or property damage. It is further acknowledged that there may be risks, dangers and hazards not known to SAMRU, or not reasonably foreseeable at this time, or caused by the negligence of other participants or third parties. I acknowledge that I am voluntarily participating in the SAMRU Activity. I freely accept and voluntarily assume any and all risks, dangers and hazards with my participation.

By signing this Agreement, I acknowledge and I am aware that participating in the SAMRU Activity involves accepting the inherent and other risks, dangers, and hazards associated with the SAMRU Activity, including but not limited to:

1. TRAVEL - (including but not limited to car pooling, bus travel or other forms of transportation, including guided tours Road, pathway and highway travel involves risk of accident or injury related to excess speed, poor driver(s), road conditions, unsafe vehicles and equipment or illegal operation of vehicles.

2. WEATHER - Weather conditions may be extreme and can change rapidly without warning.

3. EQUIPMENT - Any equipment used during an event or activity as an aid or safety measure may fail or break.

4. SITE VISITATION/TOURS/ACCOMMODATION -Tour activities, programs and logistical arrangements may involve risks or safety issues which need to be assessed, monitored and reacted to, as appropriate. Slips, falls, exposure to moving objects or equipment, and interaction with fellow participants may result in harm, loss or damage to me.

5. SPORTING ACTIVITIES - Sporting activities, safety equipment, instruction, facility maintenance, environmental and weather conditions may involve risks or safety issues which need to be assessed, monitored and reacted to, as appropriate. Slips, falls, exposure to moving objects or equipment, and interaction with fellow participants may result in harm, loss or damage to me.

6. ADD ANY ACTIVITY-SPECIFIC RISKS

By signing this Agreement I freely accept and fully assume all such risks, danger and hazards and the possibility of personal injury, death, property damage or other loss resulting therefrom.

Liability Release

In consideration of SAMRU accepting this form and allowing me to participate in the SAMRU Activity, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, I on behalf of myself and my heirs, executors, assigns and administrators hereby release, waive and discharge SAMRU, its organizers, sponsors, partners, successors, predecessors, subsidiaries, affiliates, members, executives, employees, volunteers, board members, representatives and agents (collectively the "Released Parties") from any and all liability, actions, causes of action, suits, debts, statutory obligations, sums of money, claims, losses, damages, expenses (including legal fees), for injuries, damages, or losses of any and every kind whatsoever, at law or in equity (collectively the "Claims"), which against the Released Parties I ever had, now have, or can hereafter have arising out of or in any way connected to my participation in the SAMRU Activity, including but not limited to losses and damages resulting from bodily injury, death, property damage or loss resulting therefrom.

 

Indemnification and Hold Harmless

I agree to indemnify and hold harmless the Released Parties from and against all Claims arising out of or related to my participation in the SAMRU Activity.

I accept all the inherent risks of the above activities and the possibility of personal injury, death, property damage or loss resulting therefrom.

BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND ALL OF THE TERMS AND CONDITIONS OUTLINED IN THIS WAIVER, AND I VOLUNTARILY AGREE TO BE BOUND BY THEM WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME. I CONFIRM THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
