To enter the festival, a copy of this waiver must be completed and signed for every patron. Before signing, please read the waiver in full and be certain that you understand the implications of signing. By signing, you agree to all conditions below.

🌀 Assumption of Risk

By signing below, I acknowledge that I understand and voluntarily assume all risks associated with entering and participating in activities at Steeplechase Ski Resort, including but not limited to:

• Natural terrain hazards: uneven ground, hills, rocks, roots, holes, slopes, loose gravel, mud, and wet or slippery areas
• Water hazards: deep or shallow water, unstable shoreline, slippery banks
• Weather hazards: lightning, storms, high winds, heat, cold, falling branches, and rapidly changing conditions
• Wildlife risks: insects, bees, snakes, and other animals
• Fire-related hazards: campfires, fire performances, sparks, hot surfaces
• Festival activities: dancing, yoga, workshops, movement, amplified sound and lighting
• Camping hazards: tents, stakes, fire rings, camping equipment, tripping hazards
• The actions, conduct, or negligence of other attendees, volunteers, vendors, or third parties

I understand these risks may result in serious injury, illness, disability, or death.

⚠️ Dangerous Property Conditions Acknowledgment

I acknowledge that Steeplechase is a natural outdoor environment containing hazards including uneven surfaces, shifting terrain, rocks, mud, large hills, slippery areas, erosion, water edges, and other natural conditions.

I understand and agree that:

I Will keep off the Ski Chair Lifts and all other Property where signs are posted to keep out.

I accept full responsibility for navigating the terrain safely and for my decision to enter the property.

🔓 Release and Waiver

In consideration for being allowed entry and participation in the festival, I knowingly release and discharge:

Releasees: Frequency Flow Fest L.L.C., Emily Thompson (Festival Director), and all event workers including volunteers, staff, contractors, helpers, performers, vendors, and partners (collectively “Releasees”).

This release covers all liability for personal injury, property damage, or wrongful death arising from my participation, whether caused by negligence or otherwise. I agree that I am releasing Releasees from liability for injuries or damages arising from:

Natural land conditions, terrain hazards, water hazards, weather or environmental conditions, wildlife, camping-related conditions, equipment, structures, or facilities
the actions or negligence of other attendees, volunteers, or third parties

I have read this release of liability and assumption of risk agreement, and I fully understand its terms and release all liability and reliquish a legal right by signing it. 

🛡️ Indemnification

I agree to indemnify, defend, and hold harmless Frequency Flow Fest L.L.C., Emily Thompson (Festival Director), its founders, owners, producers, staff, volunteers, partners, affiliates, sponsors, vendors, performers, venue, contractors, helpers, and all event workers (collectively “Releasees”) from and against any and all claims, demands, actions, suits, causes of action, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees and court costs) arising out of or relating to:

• My participation in or presence at the event
• My actions, conduct, or negligence
• My failure to follow festival rules or safety instructions
• Injuries or damages involving my dependents or guests
• Property damage, fire, or injuries caused by my camping gear, vehicle, or equipment

This includes, without limitation, claims arising from injury, illness, death, theft, damage to property, or other loss suffered by me or caused by my actions during the event, except where prohibited by Minnesota law.

This indemnification applies to all ticketed guests, volunteers, vendors, and performers and extends to any claims made by or on behalf of my family members, dependents, heirs, or assigns. I understand that this agreement is intended to be as broad and inclusive as permitted by Minnesota law.

🌩️ Weather, Conditions, and Force Majeure
I understand and agree that:

• The event may continue during rain, storms, wind, heat, cold, or other adverse weather
• Weather may create additional hazards such as mud, slippery terrain, falling debris, or poor visibility
• I am responsible for my own shelter, clothing, and weather protection

I further agree that:

No refunds will be issued due to weather, acts of nature, emergencies, government orders, or other force majeure events outside the control of Frequency Flow Fest L.L.C.

🛑 Safety and Removal Policy
Festival staff and security, acting on behalf of Frequency Flow Fest L.L.C., may remove any individual from the event grounds, without refund, for:

• Behavior that jeopardizes safety
• Violations of festival rules or posted signage
• Harassment, disorderly conduct, or illegal activity
• Entering restricted or unsafe areas
• Posing a risk to the well-being of others

I agree to follow all safety instructions and emergency procedures.

 

 📜 Additional Terms
    •    I am participating voluntarily and at my own risk
    •    I will supervise any minor children at all times
    •    I will follow all posted signs and safety instructions
    •    NO CLIMBING ON SKI LIFT. It is off limits.
    •    I am financially responsible for any medical treatment required
    •    This agreement is binding on my heirs, executors, and assigns

✅ Acknowledgment

I have read and understand this agreement. I voluntarily sign this waiver, knowing that it releases legal rights and limits my ability to seek compensation for injuries.

👨‍👩‍👧 For Parents or Guardians

As the parent or legal guardian, I certify that I will supervise my minor child AT ALL TIMES during the event. The minor may not wander unattended. I release all Releasees from liability on behalf of myself, my minor child, and our heirs.
