Waiver of Liability, Indemnification, & Hold Harmless Agreement
Activity Organizer: Maple Border Events, LLC.___
Activity Location: Maple Border Farm, LLC. at 3000 White Hall Road, White Hall, Maryland 21161 (the “Property”)___
Activity: Maple Border Farm’s Corn Maze_(the “Activity”)___
As a condition to visiting and entering onto the Property, the signatory below executes and delivers this release and waiver. I fully understand that by signing this agreement, I waive, release, and relinquish, any and all right to seek the recovery of damages for any personal injury, property damage, other cause of action, known or unknown, which may arise from my entry onto the Property and Activity associated therewith.

1. Waiver of Liability: In consideration for receiving permission to participate in the Activity, I on behalf of myself, my family members, my heirs, personal representatives, and/or assigns, do hereby agree to WAIVE, RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Maple Border Events, LLC and Maple Border Farm, LLC, and or its business owners, parents and affiliates, and its and their respective affiliates, employees, volunteers, land owners, vendors, and assigns or any and all of them (hereinafter Maple Border Events, LLC and Maple Border Farm, LLC collectively the “Farm”) from any and all liability, claims, demands, damages, costs, expenses, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in such activity, while in, on or upon the Property, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE (ACTIVE OR PASSIVE) OF THE FARM.
2. Assumption of Inherent Risks: I am fully aware, understand and acknowledge that there are inherent risks involved in entering the Property and participating in the Activity, agricultural and agritourism related activities, which risks include but are not limited to, serious bodily injury, physical harm, illness and possibly death to participants. These risks include but are not limited to walking through fields, uneven terrain & hills, participating in wagon rides, entering the corn maze, climbing on designated farm equipment, climbing on other offered activities such as a bounce house, being around campfires, bacteria and illnesses including but not limited to COVID-19. I acknowledge that the operation of equipment, behavior of any animal, and customary agricultural or agritourism activities conducted at the Farm is contingent to some extent upon the ability of the operator and participant.
3. I recognize my responsibility to INSPECT paths and other facilities within the Property, to exercise GOOD JUDGMENT, to ACT RESPONSIBLY, and to OBEY all of the Farm’s oral or written guidance, instructions (including signage), and warnings. I agree to stay in the designated areas for the Activity and I will not trespass onto farm property that is not designated for the Activity. As an adult, I will supervise my child(ren) and any other children under my care at all times and ensure they follow the rules.

4. I understand the Farm does not require me to participate in the Activity. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me, or any loss or damage to personal property owned by me, as a result of being engaged in the Activity, WHETHER CAUSED BY THE NEGLIGENCE OF THE FARM or otherwise.
5. INDEMNIFICATION: I AGREE TO INDEMNIFY AND HOLD HARMLESS the Farm. I agree not to bring any claims, demands, actions and causes of action, and/or litigation, against the Farm for any economic and non-economic losses due to bodily injury, death, and/or property damage sustained by me in relation to the premises and operations of the Farm.
6. I voluntarily ASSUME THE RISK OF INJURY OR EVEN DEATH while participating in the Activity or entering the Property. If I am injured, I authorize the Farm to provide EMERGENCY FIRST AID and any medical or first aid personnel to provide MEDICAL CARE until such time as I or someone authorized by my medical care power of attorney or otherwise by law is able to act on my behalf.
7. I RELEASE to the Farm and AUTHORIZE the Farm to produce, reproduce, broadcast, and otherwise use PHOTOS, VIDEOS, and other depictions, likenesses, or images of me, in any media form in connection with my attendance at or participation in the Activity, without compensation, for an unlimited time.
I am 18 YEARS OF AGE OR MORE or I am SIGNING AS PARENT OR GUARDIAN of a minor child with the consent of the other parent or guardian (if any). I understand that I may be giving up the rights of my child and spouse to sue as well as giving up my own right to sue. I have read and understood these promises and am VOLUNTARILY signing below INTENDING TO BE LEGALLY BOUND.
