Release, Waiver and Acknowledgment of Risk and Terms
RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS,
INDEMNITY, AND PHOTO RELEASE AGREEMENT (the “Agreement”)

By signing this Agreement, you are agreeing to give up or waive certain legal
rights you or your minor child may have, including the right to sue or claim compensation for injury, damages or loss.

I wish to take part in, and/or wish to have my child under 18 (the “Minor Participant”) participate in, the De Havilland Canada Event, taking place at the Canada Aviation and Space Museum in Ottawa, Ontario, Canada, offered by De Havilland Aircraft of Canada Limited (“DHC”) in which, as part of the event, the signatory (or the Minor Participant) may ride in an aircraft free of charge as a demonstration (the “Event”).

I am the participant (or the parent/legal guardian of the named Minor Participant under 18) and represent and warrant that I have the legal authority to enter into this Agreement, and on the Minor Participant’s behalf. In exchange for being allowed to take part in the Event, the participant (and/or their parent/legal guardian) agrees to the following:
1. RELEASE OF LIABILITY*

I, on behalf of myself and, if applicable, the Minor Participant, for ourselves, our heirs, family members, personal representatives, and assigns, hereby release and forever discharge DHC and its affiliates, and their officers, directors, employees, agents, volunteers, sponsors, insurers, contractors, and aircraft owners or operators (collectively, the “Released Parties”) from any and all claims, demands, or causes of action I or the Minor Participant may have for any injury, death, loss, or damage arising from or connected with participation in the Event, including but not limited to claims based on negligence, unless such claims result from the willful misconduct of the Released Parties.
2. COVENANT NOT TO SUE*

I, on behalf of myself, and if applicable, the Minor Participant, for ourselves, our heirs, family members, personal representatives, and assigns, covenant not to sue or make any claim against the Released Parties for any injury, death, loss, or damage arising from participation inthe Event, including claims based on negligence, unless resulting from the willful misconduct of the Released Parties.
3. ASSUMPTION OF RISKS*

I, on behalf of myself and, if applicable, the Minor Participant, acknowledge and understand that flying in aircraft and being around aircraft involves inherent risks. Serious injury or death can result from many causes, including but not limited to: aircraft crashes, hard or forced landings, and collisions; pilot error, ground crew error, or air traffic control error; engine or mechanical failure, negligent maintenance, or fuel contamination; interference by birds or other objects; or weather conditions, runway conditions, or turbulence. Injuries from such inherent risks could be minor (e.g., bruises, scratches, sprains, etc.), serious (e.g., fractures, concussions, burns, etc.), or catastrophic (e.g., paralysis, death, etc.). If the participant is a minor, I represent and warrant that I am the parent/legal guardian of the Minor Participant, that I have explained these risks to the Minor Participant to the extent the Minor Participant is capable of understanding them, and that I freely and voluntarily accept and assume all such risks on behalf of myself and the Minor Participant. I acknowledge that I am fully responsible for the Minor Participant’s participation in the Event and for the Minor Participant’s understanding and acceptance of the risks involved.
4. INDEMNITY*

I, on behalf of myself and, if applicable, the Minor Participant, agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, actions, or expenses of any kind, including but not limited to legal fees, brought against the Released Parties by any third party arising out of or relating to my participation, or the participation of the Minor Participant, in the Event.
5. PUBLICATION AND PHOTO RELEASE*

By signing this Agreement, I, on behalf of myself and, if applicable, the Minor Participant: grant DHC the right to take images, photographs or videos of me and/or my family in connection with the Event; authorize DHC, its assigns, and transferees to copyright, use, and publish the images, photographs or videos in print and/or electronically; and agree that DHC may use such photographs or videos for any lawful purpose, including publicity, illustration, advertising, and web content.
6. LEGAL ADVICE*

I acknowledge that I have had the opportunity to seek independent legal advice regarding this Agreement, should I desire to do so. I freely and voluntarily sign this Agreement, intending it to be a binding waiver and release of liability enforceable against me, my heirs, executors, administrators, and assigns, to the fullest extent permitted by law.
7. GOVERNING LAW AND JURISDICTION*

This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
8. SEVERABILITY*

If any provision of this Agreement is found to be invalid or unenforceable, the remainder of theAgreement shall remain in full force and effect.
9. ACKNOWLEDGEMENT OF UNDERSTANDING*

I have read and fully understood this Agreement, and I am aware that by signing, I am waiving certain legal rights that I (and, if applicable, the Minor Participant) may have against the Released Parties. This Agreement shall be binding up on the participants, their heirs, executors, administrators, successors, and assigns;I understand that completing this form does not guarantee a seat on a flight;I confirm that myself and guest (if applicable) are residents of the Ottawa-Gatineau region;I acknowledge that there is no Flight Attendant on board and thatemergency exit seating requires an able-bodied passenger; andI have read and agree to the above terms and this RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, INDEMNITY, AND PHOTO RELEASE AGREEMENT.
