Parental Consent and Liability Waiver
This Parental Consent and Liability Waiver (the “Agreement”) is entered into by and between Ms. Defense, LLC, a California limited liability company (the "Company" or “Instructor”), and the undersigned parent or legal guardian (the “Parent/Guardian” or "I"), on behalf of the minor participant (the “Participant”).
I understand and acknowledge the nature of the activities involved in Firearms or Self-Defense training, which may include but are not limited to:
- Introduction to firearm safety
- Discussion of crimes and criminal activity
- Videos, photos, and other content that demonstrates or shows criminal activity
- Physical/hands-on demonstrations, including martial arts moves
- Other content and activities that may be sensitive for minors
1. Acknowledgment of Risk
I, the Parent/Guardian, understand and acknowledge that firearms training, self-defense instruction, and related activities involve inherent and significant risks. These risks include, but are not limited to:
- Exposure to live ammunition and firearms handling
- Bruises, sprains, strains, or other physical injuries resulting from self-defense or martial arts training
- Hearing or vision injury
- Inhalation of contaminants, exposure to airborne debris, or physical contact with other participants
- Serious injury, paralysis, permanent disability, or death.
I acknowledge that while the Ms. Defense and its instructors will take reasonable precautions, these risks cannot be fully eliminated.
2. Voluntary Participation
I consent to the Participant's voluntary participation in firearms and self-defense training. I understand that such participation is at the Participant's own risk and that my decision to allow participation is voluntary and made with full awareness of the risks.
3. Release and Waiver of Liability
In consideration of the Participant's participation in the training, I hereby voluntarily and knowingly release, discharge, and hold harmless Ms. Defense, LLC, its instructors, officers, directors, staff, employees, contractors, agents, representatives, property owners, and affiliates (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, causes of action, damages, or losses (including attorney’s fees) arising out of or related to my child’s participation in the training, including those arising from the negligence of the Released Parties, to the fullest extent permitted by law.
4. Indemnification
I further agree to indemnify and hold harmless the Released Parties against any and all claims, damages, losses, or expenses (including attorney’s fees) brought by or on behalf of my child, myself, or any third party as a result of the Participant's participation in the training.
5. Firearms and Equipment Use
I hereby give the Participant express permission and consent to use, be lent, and possess firearms (handguns and long guns) and ammunition to engage in lawful, recreational sport. (Cal. Penal Code §§ 27945, 29610, 29615, 29650, 29655; 18
U.S.C. § 922(x)
The Parent/Guardian acknowledges and agrees that any firearm used by the minor Participant during training shall be provided by the Parent/Guardian. Such firearm must be legally owned and possessed by the Parent/Guardian, and must be in safe, operable condition, properly maintained, and compliant with all applicable federal, state, and local laws. The Parent/Guardian assumes full responsibility for ensuring the firearm’s legality, functionality, and safe operation, and further agrees that neither the Company nor its instructors shall be responsible for providing firearms for the minor Participant’s use.
I agree that my child may be loaned and permitted to use firearms or equipment provided by the Instructor or the Company, under direct supervision and in accordance with all safety protocols.
I accept full financial responsibility for any damage to the Company’s or Instructor’s firearms or equipment caused by my child’s negligent, reckless, or intentional conduct.
6. Safety and Conduct
I understand and agree that:
- My child must follow all safety rules, range protocols, and instructor directions at all times;
- The Instructors may immediately terminate my child’s participation for unsafe or inappropriate behavior without refund
- My child shall not be under the influence of drugs, alcohol, or any impairing substance during training.
7. Medical Authorization
I certify that my child is in good health and has no condition that would make participation in firearms safety or self-defense classes unsafe. I authorize the Company, its instructors, or emergency medical personnel to secure and perform medical care for the Participant in the event of injury or illness, and I assume full financial responsibility for any such care.
8. Certification of Legal Guardian
I certify that I am the parent or legal guardian of the minor Participant, have full authority to sign this Agreement, and am over the age of 18.
9. Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
