LIL PLAY CAFÉ WAIVER
ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY

I, the undersigned, have carefully reviewed the contents of this waiver and release, and I knowingly and voluntarily enter into this agreement, recognizing and accepting that I am giving up my right to sue. I desire to allow my child(ren), and/or the child(ren) entrusted to my care, to use the facilities, participate in activities, and enjoy all offerings at Lil Play Café.

This Assumption of Risk, Waiver, and Release of Liability covers all activities, equipment, play structures, events, snacks/beverages, and any form of supervision provided at Lil Play Café. I understand that any individual who has not agreed to and signed this waiver is not permitted to enter the play areas or participate in any activities at Lil Play Café.

I affirm that I am the parent or legal guardian of the child(ren) listed below and am legally authorized to make decisions on their behalf. I also acknowledge that minor children must be accompanied and actively supervised by their parent, legal guardian, or an authorized adult at all times while inside Lil Play Café.

1. RISK FACTORS
I understand that using the play facilities at Lil Play Café involves inherent risks, including, but not limited to: slips, falls, bumps, bruises, collisions with equipment or other children, minor or serious bodily injuries, illness, or even death. These risks may arise from the nature of play activities, other participants, lack of supervision, or equipment use.

2. ASSUMPTION OF RISK
I am choosing to allow my child(ren) and/or the child(ren) in my care to use Lil Play Café’s facilities at our own risk. Lil Play Café makes no guarantees regarding the safety of its facilities or equipment. I understand that Lil Play Café does not provide child supervision and it is my sole responsibility to supervise the children in my care at all times.

I accept full responsibility for all risks of injury or harm, including use of play structures, toys, materials, snacks, beverages, and other amenities, and agree to hold Lil Play Café harmless from any liability arising from these risks. I understand that I am solely responsible for any medical or personal injury costs associated with any incident occurring at Lil Play Café.

3. ACKNOWLEDGEMENT OF POLICIES AND PROCEDURES
I acknowledge that I have read, understood, and agree to follow all posted rules and policies of Lil Play Café. I understand that failure to follow these policies may result in immediate removal from the facility without refund and/or the loss of future access privileges.

4. RELEASE, INDEMNIFY, AND DEFEND
I hereby release, waive, discharge, and agree to indemnify and hold harmless Lil Play Café, including its owners, employees, volunteers, contractors, and representatives, from any and all claims, liabilities, damages, losses, or expenses arising from property damage, personal injury, illness, or death related to the use of the facilities.

5. PREREQUISITE SKILLS
I certify that all children I am responsible for are physically and emotionally capable of safely participating in play activities at Lil Play Café. I understand that Lil Play Café has not conducted any screening of my child(ren)’s physical condition or abilities, and I am solely responsible for determining their fitness for participation.

6. WAIVER
I waive any rights or protections provided by local, provincial, or federal laws that would limit the enforceability of this waiver. In the event that any portion of this waiver is deemed unenforceable, the remainder will still be in effect. Any disputes arising from this waiver will be resolved by binding arbitration in Ontario, with both parties selecting one arbitrator who will together appoint a neutral third arbitrator.

7. REPRESENTATIVES
This waiver is entered into on behalf of myself, my child(ren), and any child(ren) under my care, and is binding on my heirs, assigns, and legal representatives.

8. EMERGENCY CARE
In the event that emergency First Aid is rendered, I understand and agree that I am waiving any and all claims resulting from such aid, and that this waiver remains fully effective.

CONSENT AND RELEASE
I have read and understand this Assumption of Risk, Waiver, and Release of Liability. I understand that by signing, I am surrendering valuable legal rights for both myself and the children in my care. I agree to be legally bound by its terms.
