  • In consideration for being allowed to participate in this Activity, on behalf of myself and my next of kin, heirs and representatives, I release from all liability and promise not to sue The Cal EPIC and their employees, officers, directors, volunteers and agents from any and all claims, including claims of the company’s negligence, resulting in any physical or psychological injury (including paralysis and death), illness, damages, or economic or emotional loss I may suffer because of my participation in this Activity, including travel to, from and during the Activity.

    I am voluntarily participating in this Activity. I am aware that an active shop in the facility can be a hazardous location, and that participation in this education program may pose a serious risk of injury. I am aware of the risks associated with traveling to/from and participating in this Activity, which include but are not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and/or death. I understand that these injuries or outcomes may arise from my own or other’s actions, inaction, or negligence; conditions related to travel; or the condition of the Activity location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in this Activity, including travel to, from and during the Activity.


     

    I agree to hold The Cal EPIC harmless from any and all claims, including attorney’s fees or damage to my personal property, that may occur as a result of my participation in this activity, including travel to, from and during the Activity. If The Cal EPIC incurs any of these types of expenses, I agree to reimburse The Cal EPIC. If I need medical treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

     


    I hereby agree that I will not make a claim against or sue the Company in any forum on account of: (1) injury or damage resulting from acts (negligent or otherwise) or injury, howsoever caused, (2) any condition on the Facility or nearby property, (3) any action or inaction of any employee, representative, invitee, guest, or agent of the Company, or (4) otherwise as a result of my participation in this educational program. I hereby release the Company, from any and all actions, claims, liabilities, losses, demands, damages, costs, and expenses that I may have or incur as a result of any injury or damage resulting from my participation in the educational program described herein or presence at or near the Facility.


     

    I am 18 years or older. I understand the legal consequences of signing this document, including (a) releasing Cal EPIC from all liability, (b) promising not to sue Cal EPIC (c) and assuming all risks of participating in this Activity, including travel to, from and during the Activity.

     

    I understand that this document is written to be as broad and inclusive as legally permitted by the State of California. I agree that if any portion is held invalid or unenforceable, I will continue to be bound by the remaining terms.

     

    I have read this document, and I am signing it freely. No other representations concerning the legal effect of this document have been made to me.

  • Refund Policy Notice

  • Refunds

    Refunds are not offered, except in cases of legitimate extenuating circumstances (e.g., serious illness), which will be reviewed on a case-by-case basis. In most cases, missed sessions will be handled through rescheduling, not refunds. If a refund is approved, it will be processed to the original form of payment. Cash or check refunds will not be issued under any circumstances.


    Cancellations, Missed Classes, and Rescheduling 

    Classes will be conducted only if a minimum of four participants are enrolled. In the event that a class is canceled due to low enrollment or other unforeseen circumstances, refunds will not be issued. Instead, participants will be offered the opportunity to reschedule for a future session at no additional cost. If a participant misses a scheduled class, we will reach out to offer a chance to reschedule for a future session at no additional cost. Participants are encouraged to contact us directly to arrange a reschedule if they know they will miss a session. Participants may reschedule their training up to 1 time. After exceeding this limit, their original payment will be forfeited. If the participant wishes to re-enroll in the course they will be required to submit a new payment. 


    Exam Failure and Retake Policy

    Certification for the forklift class requires successful completion of two assessment components: a written exam and a driving evaluation. Participants will be given multiple attempts to pass each component. 


    If a participant is unable to pass the assessment during the initial training day, they will be allowed one additional opportunity to retake the exam on a separate day. The driving portion of the exam will be limited to 30 minutes. If the participant does not successfully complete the exam within this time frame, they will be asked to reschedule for a later date in order to ensure adequate time for other participants.Failure to pass after this second attempt will result in ineligibility for certification, and no refund will be issued. The participant may choose to re-enroll in the course and submit another payment if they still wish to pursue certification.
