  • TERBO — Waiver & Release of Liability

    READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS

    This Waiver & Release of Liability ("Release") is executed by the undersigned ("Participant") in favor of TERBO ("Company"), its owners, officers, employees, contractors, agents, and affiliates.

    1. Acknowledgment of Risk

    Participant understands and acknowledges that shop use, equipment use, storage, maintenance, transportation, recovery, and related activities involve inherent risks, including but not limited to:

    Damage to vehicles or property

    Personal injury or death

    Risks arising from the actions of other participants, guests, or intruders

    Risk arising from improper use of equipment

    Participant voluntarily assumes all such risks

  • 2. Release of Liability

    In consideration for being permitted to enter and/or use the facility, Participant releases, waives, and discharges Company from any and all liability, claims, demands, or causes of action for injury, loss, or damage to person or property, whether caused by negligence or otherwise, except for Company's gross negligence or willful misconduct.

  • 3. Indemnification

    Participant agrees to indemnify, defend, and hold harmless Company from any claims, damages, or expenses (including attorney fees) arising from:

    Participant's use of the facility,

    Participant's motorcycle, equipment, or personal property,

    Participants guests, or

    Any violation of Company rules or this Release.

    4. Insurance Requirement

    Participant affirms they maintain appropriate insurance coverage (e.g., motorcycle insurance,liability insurance) and understands that Company does not provide insurance for Participant’smotorcycle, personal property, or guests.

  • 5. Guests

    If signing as a Guest, Participant acknowledges they are entering the facility under the supervision of a current Member and remain the responsibility of that Member.

    6. Governing Law & Dispute Resolution

    This Release shall be governed by the laws of the State of lowa. Any dispute shall first be submitted to mediation in Linn County, lowa, and if unresolved, binding arbitration under the rules of the American Arbitration Association.

    7. Severability

    If any portion of this Release is found invalid, the remainder shall remain in full force and effect.

  • 8. Safety Training and Certification

    Participant certifies that before using any equipment in the shop, they will have watched all required safety videos or received in-person training, and have completed their 5000-23 training certificate for that specific piece of equipment.

     

    By signing below Participant certifies they have read this Release fully understand its terms and voluntarily agree to be bound
