Volunteer Waiver and Release of Liability
I ereby acknowledge that I have voluntarily agreed to participate in manual labor activities at Hopelands Gardens and Rye Patch (the "Facilities") for the City of Aiken, South Carolina.
Nature of Volunteer Work:
I understand that the volunteer activities may include, but are not limited to:
- Gardening and landscaping
- Facility maintenance
- Assisting with tours and events
- Other manual labor as assigned
I ACKNOWLEDGE and UNDERSTAND that I am volunteering my services to the City of Aiken graciously, without any express or implied promise by the City to compensate me for my services, and I ACKNOWLEDGE and UNDERSTAND that I am not entitled to, and will not receive, remuneration of any kind, including but not limited to, salary or reimbursement for my transportation, parking, travel, or any other expenses whatsoever which may be incidental to my services as a volunteer for the City.
I ACKNOWLEDGE and UNDERSTAND that I am not an employee of the City and therefore am not entitled to any benefits normally associated with employment, including, but limited to Workers Compensation, retirement and leave accrual.
I ACKNOWLEDGE and UNDERSTAND that there has been, and will be, no promise of future employment with the City. I am donating my time and services without any compensation and shall at no time be considered an employee or independent contractor of the City. I also understand that the City does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness.
I ACKNOWLEDGE and UNDERSTAND that I am not an agent of the City and will not make any commitment on behalf of the City to third parties.
Assumption of Risk:
I acknowledge that providing volunteer labor involves inherent risks. I understand that these activities may be hazardous and can result in property damage, bodily injury, or death. I voluntarily accept and assume all risks associated with my participation in these activities.
Waiver and Release:
In consideration for being permitted to participate in volunteer activities at the Facilities, I hereby waive, release, and discharge the City of Aiken, its officers, employees, agents, and representatives from any and all claims, liabilities, and causes of action arising out of or in any way connected with my volunteer activities, including any negligence on the part of the City of Aiken.
Indemnification:
I agree to indemnify and hold harmless the City of Aiken, its officers, employees, agents, and representatives from any loss, liability, damage, cost, or expense which may incur as a result of any injury or property damage that I may cause or suffer while participating in volunteer activities.
Medical Treatment:
I consent to receive medical treatment which may be deemed advisable in the event of injury, accident, or illness during my volunteer activities. I understand that I am solely responsible for all costs related to such medical treatment.
Photographic Release:
I grant the City of Aiken permission to use my likeness in photographs, videos, or other media in any and all of its publications or promotional materials.
Understanding and Voluntary Execution:
I have carefully read this waiver and fully understand its contents. I am aware that this is a release of liability and a contract between myself and the City of Aiken, and I sign it of my own free will.
