AGREEMENT OF RELEASE AND WAIVER OF LIABILITY
I hereby agree to the following:
In consideration for the opportunity to participate in an event (“Event”) hosted at real property having an address of 9331 Charles E. Limpus Rd., Orlando FL 32836 (the “Property”) owned by Wyland Investments LLC (“Owner”), Participant hereby releases, discharges, and holds harmless the Owner (including its principals, specifically including but not limited to Jerry Hauck and Sandy Hauck, together with all employees, agents, successors, heirs and assigns) from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise: i) from the Event; and/or ii) on or about the Property. Participant understands and acknowledges that this Release forever discharges the Owner from any liability or claim that Participant may have with respect to bodily injury, personal injury, illness, death, or property damage that may result from the Event or on or about the Property, whether caused by Participant, Owner (including any negligence by Owner), another participant or other third party, the condition of the Property, or any other cause whatsoever.
Participant represents and warrants that s/he has adequate and appropriate insurance related to its participation in the Event, and that s/he voluntarily and freely accepts the risk of injury, illness, death or damage arising from Participant’s participation in the Event. Participant agrees and acknowledges that the Owner does not assume any responsibility to provide insurance related to the Participant’s participation in the Event, and Participant hereby waives and releases the Owner from any obligation to provide financial or other assistance or insurance related to Participant’s participation in the Event, including but not limited to medical, health or disability benefits, workers’ compensation insurance, or other insurance of any nature.
Participant understands that the Event may include activities that may be hazardous including, but not limited to: physical activities, recreational sports, use of equipment or facilities, exposure to natural elements, and other inherently dangerous activities that could result in physical injury, emotional injury, paralysis, death, or property damage. Participant hereby expressly assumes the risk of injury or harm from these activities and releases the Owner from all liability for injury, illness, death, or property damage resulting from the activities provided by or participated in by Participant.
Participant agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Florida, and further agrees that if any portion of this Release is held invalid, the balance shall continue in full legal force and effect. Participant also agrees that any legal action arising from participation in the Event must be filed in Orange County, Florida, and that the prevailing party shall be entitled to recover reasonable attorneys' fees and costs., and that this Release shall be governed by and interpreted in accordance with such laws. In the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.
By signing below, Participant acknowledges having read and understood this Release, agrees to be bound by its terms, and voluntarily assumes all risks associated with participation in the Event. Participant further acknowledges that s/he is of legal age and mentally competent to sign this Release.
I understand that the $50 deposit for the retreat is final with no refunds and the balance of my payment is due one month prior to the event. Cancellation fees will apply due to associated costs such as the meal service, accomodations, swag etc.
I have read the above release and waiver of liability and fully understand it’s contents as well as the Refund/Cancellation Policies. I voluntarily agree to the terms and conditions stated above.
