By signing below, each of the undersigned business and business owner/officer (individually and collectively, "you") expressly authorize Express Business Capital, LLC ("EBC") and its representatives, successors, assigns, and designees ("Recipients"), which may be involved with or acquire personal or commercial loans or financial products, including but not limited to commercial loans with daily repayment features, purchases of future receivables, and Merchant Cash Advance transactions (collectively, "Transactions"), to take the following actions for the purpose of evaluating your creditworthiness and determining eligibility for financial services or products: Authorization to Obtain Reports and Information: You authorize EBC and the Recipients to obtain consumer, personal, business, and investigative credit reports and other information about you from one or more consumer reporting agencies (including but not limited to TransUnion, Experian, and Equifax), other credit bureaus, financial institutions, creditors, or any other third parties deemed necessary. Authorization to Access Financial Records: You authorize EBC and the Recipients to request and receive financial information and documentation, including but not limited to bank statements, credit card processor statements, tax returns, and other records from financial institutions, creditors, and service providers for the purpose of evaluating your credit and financial standing. Authorization to Share Information: You authorize EBC to transmit this application, as well as any information and reports obtained in connection with this application, to one or more Recipients for the purpose of evaluating, processing, or completing Transactions or other related financial services. Consent for Release of Information: You consent to the release by any financial institution, creditor, or service provider of information pertaining to your accounts or financial history to EBC and its Recipients upon request. You acknowledge and agree that EBC and the Recipients are not obligated to extend credit or enter into any Transaction solely based on this authorization or application. Furthermore, you acknowledge that false or misleading statements or omissions on this application may result in the denial of credit and/or other legal action. Consent to Electronic Communication and Records: You consent to receive disclosures, notices, and other communications electronically. You understand that you may withdraw this consent by notifying EBC in writing, but doing so may delay or affect the processing of your application. Fair Credit Reporting Act (FCRA) Notice: Pursuant to the FCRA, you are hereby notified that EBC or the Recipients may obtain one or more credit reports or other investigative reports in connection with this application. Upon written request, you have the right to receive a copy of the report(s) obtained and to dispute any inaccurate or incomplete information contained therein. Consent to Jurisdiction: Any disputes or claims arising from or related to this application or Transactions shall be governed by the laws of the State of Idaho, without regard to its conflict of law provisions. By signing below, you affirm that you have read and understood this Authorization, Disclosure, and Notice and that you voluntarily agree to its terms.
