Our Services & Waiver Agreement
Caregiver Duties:Caregivers are childcare professionals. They will clean up any play or meal-time messes created by the children, but general house cleaning, laundry, and similar tasks should be left to your lodging’s domestic staff.
Babysitter Payments:Client(s) agrees to pay caregivers directly by cash, check, Venmo, Zelle or other cash transferring platform. Caregiver Rates: $32/hour for 1 child; $34/hour for 2 children; $36/hour for 3 children; $43/ hour for 4 children; $45/hour for 5 children. Depending on the children's ages, 5 or more children will require a second sitter, and the hourly rate will apply for each sitter. Caregiver rate will be $5 more per hour if there are 2 children under 2 years old. Holiday Pricing applies to all holidays and holiday weekends. Client agrees to pay Caregiver rate as indicated by agency.
Agency Fees:Pricing starts at $15/hour. These fees are paid via credit card. Holiday pricing applies to all holidays and holiday weekends.
Holiday Pricing:Client agrees to pay Holiday Pricing for all Holidays and Holiday weekends. Holiday pricing adds $15 - $35/hr more depending on the holiday.
Number of Children:Client agrees to disclose all children under the age of 18 and agrees to pay for each child present under the age of 18 if they are left alone with one of our sitters.
Hourly Minimums:Client agrees that each individual reservation, regardless of number of individual reservations, will adhere to a 4-hour minimum. Reservations of 8 hours or more will be held to an 8-hour minimum.
Late Arrival:Client agrees that if they are more than 45 minutes late to meet their Caregiver at the time the Client scheduled, Caregiver may leave, and Client will be charged a full cancelation fee.
Last-Minute Changes:Client agrees to pay additional fees for Last-Minute changes to a reservation. Last-minute changes include any changes made to a reservation 48-hours or less in advance. Last-minute changes, include but are not limited to, change of location, change of time, change in number of children, and/or addition of animals.
Sick Care:Client acknowledges that ABC cannot provide Caregivers for sick children. If a Caregiver arrives and the children are sick, Caregiver may leave, and Client agrees to pay all applicable Cancelation fees.
Driving Children:Caregiver’s are discouraged from driving children. If family must have Caregiver drive children, Family agrees to inform ABC and sign a Driving Waiver prior to Caregiver’s arrival.
Last Minute Reservations:Client agrees to pay a Last-Minute booking fee of $20 for any reservations made 48-hours or less in advance of Client’s requested start time. This entire fee goes directly to your Caregiver.
More than 2 children 2 Years old and under:Client agrees to pay their Babysitter an additional $5/hour for 2 children 2 years old and under
Travel and Parking:Client agrees to pay a Travel Fee for any reservations outside of ABC’s Main Service Areas. Client agrees to reimburse sitter for all parking fees incurred during Client’s reservation with Caregiver.
Reservation Time:Client understands that ABC and its Caregivers can only provide service for the schedule they have reserved. ABC cannot hold a Caregiver’s availability outside of the time Client has reserved. If a Caregiver is available to stay later or arrive earlier than the scheduled request. a reservation may be adjusted. If Caregiver is UNAVAILABLE to stay later or arrive earlier than the scheduled request, Client agrees to adhere to the originally scheduled time. If Client wishes ABC to replace Caregiver to accommodate a time adjustment, Client will pay cancellation fees in full according to cancelation policy for cancellation of Caregiver. Additionally, Client acknowledges that there is no guarantee that ABC will be able to find a replacement Caregiver for the new requested time. ABC will provide a new caregiver, with applicable last-minute fee, as availability allows.
Late Fee:Clients are required to keep ABC informed of any account changes to their credit card or bank account information. Updates/Payments that are not given to ABC within 5 days of invoice dates are subject to a $25 late fee.
Last Minute Cancellation by Caregiver:If a Caregiver becomes unavailable due to illness or inclement weather, ABC will do everything they can to replace Caregiver. If another Caregiver is not available, ABC will cancel the reservation, and nothing will be charged to the Client.Client acknowledges and accepts this risk.Client agrees that ABC will not be responsible for fees that Client incurs from other businesses due to last-minute Caregiver cancellation.
48-Hour Cancellation Policy:Client(s) agree that services must be canceled at least 48 hours in advance and failure to cancel in that timeframe will result in the obligation to pay the stated cancellation fee of $160.We cannot waive cancellation fees for any reason, including travel delays/illness/ family scheduling emergencies.
Outside 48-Hour Cancellation Policy:Client agrees to pay $20 for each individual shift canceled.
All Cancellation fees: Will incur a 5% admin fee
More than one family: Add $5/hr if more than one family is sharing one sitter.
Emergency Care:In case of emergency and Client(s) cannot be reached, Client(s) will authorize the caregiver referred by Aspen Babysitting Company to seek and obtain whatever medical treatment may be deemed necessary for the welfare of the Child(ren). Client(s) further understands and agree that Client(s) will be financially responsible for all charges, fees, and expenses incurred for such emergency medical treatment, regardless of whether medical insurance covers such charges.
Assumption of Risk; Waiver and Release:Client hereby assumes all of the risks inherent or incident to any Caregiver services coordinated by ABC. Client realizes that liability may arise from negligence or carelessness on the part of the persons or entities being released. Client hereby WAIVES, RELEASES and DISCHARGES from any and all liability, claims, demands, actions or rights of action, which are related to Client’s or Client’s child(ren)’s death, disability, personal injury, property damage, property theft or actions of any kind which may hereafter accrue to him or her which are related to or are in any way connected with participation caregiving activities incident to this Agreement, or result from travel incident to caregiving activities, the following entities or persons: ABC, including Jennifer Repetto individually, as well as ABC’s directors, officers, employees, representatives, agents, contractors, and ABC’s successors, assigns and insurers (“ABC Parties”). Client hereby INDEMNIFIES AND HOLDS HARMLESS the ABC Parties from any and all liabilities or claims made by other individuals or entities as a result of any caregiver’s actions during the performance of his or her duties pursuant to any agreement between ABC and caregiver or ABC and Client. CLIENT UNDERSTANDS THAT THIS IS A LEGAL DOCUMENT AND THAT BY SIGNING IT HE OR SHE IS GIVING UP HIS OR HER RIGHT TO SUE OR OTHERWISE MAKE A CLAIM against ABC and the ABC Parties.Client intends this Waiver and Release to be effective whether or not any loss, damage, injury or death results from negligence of ABC or the ABC Parties.Client understands that negligence means a failure to do an act which a reasonably careful person would do, or the doing of an act which a reasonably careful person would not do, under the same or similar circumstances to protect himself, herself or others from injury or death.
Indemnification and Hold Harmless:To the fullest extent permitted by law, Client shall indemnify, defend, and hold harmless ABC, Jennifer Repetto, and their respective officers, directors, employees and agents from and against all claims, damages, demands, losses, expenses, fines, causes of action, suits or other liabilities, (including all costs reasonable attorneys' fees, consequential damages, and punitive damages), arising out of or resulting from, or alleged to arise out of or arise from, the covenants and agreements set forth in this Agreement whether such claim, damage, demand, loss or expense is attributable to bodily injury, personal injury, sickness, disease or death, or to injury to or destruction of tangible property, including the loss of use resulting therefrom; but only to the extent attributable to the negligence of Client. Such indemnity obligation shall not be in derogation or limitation of any other obligation or liability of Client or the rights of ABC contained in this Agreement or otherwise. This indemnification shall survive the termination of this Agreement.
Requesting a Caregiver Outside of ABC:Client understands and acknowledges that it is PROHIBITED to request an Aspen Babysitting Company Caregiver to work outside of ABC. If a Client begins working with one of Aspen Babysitting Company’s Caregivers outside of ABC, Client agrees to pay a$2,500 placement fee for Caregiver.
Acknowledgment of Understanding:The Client(s) have read this agreement and have had the opportunity to ask questions about the same.By signing below, Client(s) acknowledges full understanding of this agreement and freely and voluntarily agree to abide by its terms.
