YOUR AGREEMENT WITH CURATED ESCAPES, INC.
Before we make arrangements for your trip, we require that you acknowledge your agreement with the following terms and conditions:
Please thoroughly review these terms and conditions of Curated Escapes, Inc. and Curated-Escapes.com, herein referred to as CEI. The booking passenger, by accepting this receipt and making payment to CEI, acknowledges that they have been advised of, reviewed, and hereby accept these terms and conditions and contract for travel-related services. These conditions apply to yourself, your family, or traveling companions that you represent or make payments on their behalf.
CEI offers retail travel services to customers, which are provided by separate and independent vendors of travel services. We do not operate, control, or otherwise provide the services of the independent travel vendors. CEI acts only as a sales agent for any airline, hotel, car-rental company, ground operator, tour operator, cruise line, shore excursion, attractions, or other travel Suppliers who provide goods or services for the passenger's trip.
While CEI prides itself on selecting quality Suppliers, we assume no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity that may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under our control. Suppliers reserve the right to deviate from the direct, customary, and/or scheduled route or itinerary for any reason, without limitation and without notice. Passenger(s) acknowledge and agree that CEI is not responsible for Supplier deviations, delays, cancellations, mandated overnight stays, missed connections, or any other condition beyond its control.
Cancellation Due to Insufficient Participation
This section outlines the terms and conditions for event cancellation if a minimum number of participants is not met by a specified deadline.
1. Cancellation Policy: Minimum Participation Requirement
The event requires a minimum of 10 participants to proceed. This event may be cancelled if the minimum number is not registered by January 1, 2026. The organizers reserve the right to make this cancellation at their sole discretion.
2. Notification of Cancellation
If the minimum number of participants is not reached, all registered participants will be notified of the cancellation via email at the earliest possible date after January 1, 2026. We will make every effort to provide prompt notification to minimize any inconvenience.
3. Full Refund of Registration Fees
In the event of cancellation due to insufficient participation, all participants who have paid a registration fee will receive a full refund.
Refunds will be processed to the original method of payment within [Number] business days following the cancellation announcement.
No action is required by the participant to initiate this refund.
4. No Further Liability
Upon providing a full refund of the registration fee, the organizers shall have no further liability to the participant in connection with the cancellation. This includes, but is not limited to, any costs, damages, or expenses incurred by the participant for related arrangements such as: travel arrangements (e.g., flights, train tickets), accommodation, or other associated personal or business expenses. By registering for this event, participants acknowledge and accept these terms and conditions, including the limitations on liability in the event of a cancellation.
Cancellation by participants, made in writing, will be eligible for refunds, minus a $400 non-refundable deposit per person, until January 30, 2026. After that date, no funds will be eligible for refunds.
Force Majeure: “Force Majeure” means, in relation to CEI, any circumstances beyond the reasonable control of CEI, (including, but without limitation, acts of God, explosion, flood, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences). CEI shall not be liable for any loss or damage incurred by you as a consequence of any of the Suppliers being unable to perform its obligations due to the unusual or unforeseeable circumstances (a “force majeure event”) beyond the control of the party affected by the force majeure event.
Passenger(s) acknowledge and understand that golf courses, tour operators, and other Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. Pricing and availability may change without notice. Passenger(s) agree that CEI is not responsible for any errors or omissions in any quotes, advertisements, including on our website, resulting in inventory, content, or pricing discrepancies, nor is CEI responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold CEI harmless for any actions or damages arising from Supplier pricing.
Prices are not subject to increase after you make full payment; however, a price increase may apply due to changes in: transportation costs e.g. fuel, scheduled air fares and any other airline surcharges which are part of the contract between airlines (and their agents) and CEI, Government action such as increases in VAT or any other Government imposed increases, currency in relation to adverse exchange rate variations. Passenger(s) acknowledge and consent to any post-purchase price increases in relation to the above paragraph.
Booking Accuracy/Legal Names: Passenger(s) is required to immediately review all aspects of their booking to verify (but not limited to): passenger names, mailing address, date of birth, pricing, airfare, arrival/departure airports, accommodations, and organized activities on your booking confirmation. Please notify CEI immediately if any omissions and/or corrections are needed regarding the booking details. Passenger(s) voluntarily assume full and sole responsibility for all risks and/or costs involved with failure to report such errors and/or omissions. The name, date of birth, and gender that appear on your passport or government-issued ID must exactly match the same data that is listed on airline ticket(s) and booking records. CEI strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the return date of travel. Non-United States citizens may require additional documentation. Children and infants also require all such travel documents.
CEI has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, climate extremes, or the suitability for disabled persons of any portion of any tour at locations to which you may travel. For information concerning possible dangers at destinations, we recommend you contact the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, we recommend you contact the Centers for Disease Control at (800) CDC-INFO or www.cdc.gov/travel. You assume complete responsibility for checking and verifying all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release CEI from all claims arising out of any problem covered in this paragraph, and to submit all other claims against us within 30 days after the return of your trip. You agree that all suits in connection with, or incident to, this agreement shall be litigated, if at all, in the courts in Miami-Dade County, FL, which will serve as the exclusive jurisdiction for all claims brought by you or CEI and you hereby submit to the personal jurisdiction of those courts.
Power of Attorney: As our client, you hereby appoint CEI to be your attorneys-in-fact for the purpose of signing all documents necessary to purchase and issue airline tickets, tours, cruises, insurance, and hotel guarantees. You authorize any of the attorneys-in-fact to authorize credit card authorizations for said purchases whenever any of them receives an online, phone, or email booking request reasonably believed to be from you or someone acting on your behalf, requesting travel arrangements be charged to this credit card account. You agree that you will pay for all such purchases and will not hold us responsible for any of our actions pursuant to this power of attorney.
Information on Website: The content and images contained on this website, including downloadable files, are protected by copyright. You agree not to use or authorize the use of this information for any purpose other than personal use, and not to engage in the resale, redistribution, or use of the information on this website for commercial purposes. This website may contain third-party links and pointers, which are included solely for your convenience and do not constitute any endorsement by CEI and/or our Suppliers. While every effort has been made to ensure the accuracy and completeness of this information, CEI is not responsible for the accuracy of the information or the contents of the websites.
Electronic or handwritten signature: Both parties agree that you may acknowledge and agree to these Terms: (a) electronically; (b) by handwritten signature; (c) by any other electronic means, including without limitation acknowledgment via email acceptance of these Terms; or (d) by your implied consent deemed via your actions which shall include without limitation the payment of the invoice and/ or your use of the services provided by CEI or any other travel supplier related to your booking. All such means will be deemed to constitute effective acknowledgment and execution of this Agreement and shall be sufficient to bind the parties to the terms and conditions of this Agreement.
Travel insurance protection is strongly recommended. As your travel agent, we have a professional responsibility to recommend the purchase of travel insurance to cover certain risks inherent in travel to protect against THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY PROTECTION, DELAY, INTERRUPTION, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES. By declining appropriate travel insurance, passenger(s) acknowledge and accept liability for any cancellation penalties, damages, and/or out–of-pocket expenses incurred.
If purchasing travel insurance, we urge you to thoroughly read your policy’s confirmation of benefits. This information includes, but is not limited to, details on the extent of coverage and procedures for making a claim. Please note that the travel insurance provider may not be allowed to discuss your claim with CEI due to privacy laws (e.g. HIPAA). Passenger(s) acknowledge and agree that THT has no control over the travel insurance provider or its coverage decisions, and as a result CEI is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.
AUTHORIZATION AND RELEASE FOR USE OF PHOTOGRAPHIC IMAGES AND VIDEO
I hereby grant to CEI and its agents, officials, representatives, or assigned agencies, including officers, employees, or related personnel both individually and collectively (the “Released Party”) the absolute and irrevocable right and unrestricted permission in respect of photographic portraits, videos or pictures that the Released Party had taken of me (the “Photographic Images”), whether individually or together with one another and/or other individuals and the content of any verbal or written statements made by me and used in connection with such Photographic Images, in the name of the Released Party or otherwise.
I further grant to CEI the absolute and irrevocable right to use, re-use, publish and re-publish the Photographic Images in whole or in part, individually or in conjunction with other photographic images, and in art, editorials, advertising and trade, or any other purpose whatsoever including, without limitation, the promotion of any websites or brands owned or operated by the Released Party without restriction as to alteration; by any medium or channel including but not limited to television, radio, newspaper or other periodical, Internet, or any other means whether electronic or otherwise; and to use my name, location, profession, and/or any other identifying or potentially identifying information in connection therewith if the Released Party so chooses.
I hereby release and discharge the Released Party from any and all claims and demands arising out of or in connection with the use of the Photographic Images, including without limitation any and all claims for libel, invasion of privacy, or false light, and from any and all liability for damages of whatever kind, which may, at any time, result to me, my heirs, legal representatives, and assigns because of compliance with this Authorization and Release.
This Authorization and Release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of the Photographer, as well as the persons for whom s/he took the Photographic Images.
LUXOR HOTEL POLICIES
- Check-in starts at 3:00 P.M. and check-out is at 11:00 A.M. All early check-in or late check-out requests can be noted, but not guaranteed.
- A credit or debit card is required upon arrival to register. The hotel will place an authorization amount of $$75.00 per night against the card for incidental charges to allow the guest access to room charging privileges and may result in additional authorizations should guest charges exceed the originally approved amount. Guests using a debit card in lieu of a credit card acknowledge unused funds will be released upon check-out and may take 3-7 business days for domestic banks and up to 30 days for international banks to become available through their financial institution. Please note, these are based on standard rooms. Suite incidental holds will be higher than the below.
- We strive to accommodate all room requests (including view, proximity, adjoining, or connecting rooms). Requests must be made through your Social Occasions Specialists or directly with front desk. Room requests are subject to availability and will not be guaranteed. All room numbers are assigned upon check-in.
- Outside food and beverage is strictly prohibited within all areas of the hotel. If Guest is hosting a reception or entertaining in the Suite all Food and Beverage must be provided by the Hospitality team.
- Smoking any substance, including cigarettes, cigars, pipes, e-cigarettes, hookah, vaping, marijuana, and any other substance, inside a guest room or suite is strictly prohibited. It is not lawful to smoke, consume, possess, or distribute marijuana products (whether recreationally or for medicinal purposes) or any other illegal substance anywhere at the resort, including in guest rooms or suites. Any paraphernalia commonly associated with marijuana, or any other illegal substance is also strictly prohibited anywhere at the resort, including in guest rooms or suites. Any such substances and products are subject to immediate confiscation. Any violation of this policy will result in a smoking fee of $350.00 - $1,000.00 (plus applicable taxes), additional cleaning fees of $500.00 (minimum) and any additional fees and costs that may be incurred to deep clean and/or repair a guest room or suite. Violation of this policy may result in eviction and/or trespass from the resort.
- Primary guest in the room must be 21-years of age or older.
- Per resort policy, all filming and photography requests must be presented and approved by the Public Relations department. Once approved, the photo/video activity must also be supervised by a PR representative. This includes all public areas and resort rooms.
- Professional photography/videography for personal or commercial use, anywhere in the resort, is not permitted.
- Furniture removal or relocation is not permitted.
- If for any reason beyond the Hotel’s or ’s reasonable control (including but not limited to strikes; labor disputes; acts, regulations or orders of governmental authorities; pandemics or epidemics; civil disorder; disasters; acts of terrorism: acts of war; acts of God; fires; flood or other emergency conditions; any delay in necessary and essential repairs of the Hotel, curtailment of transportation such that at least 60% of attendees cannot arrive at the Hotel) making it impossible or illegal for the Hotel or to perform its obligations under this Agreement, such non-performance is excused and such affected party may terminate this Agreement without further liability of any nature, and any Deposit shall be returned. The parties agree to negotiate in good faith to rebook any Event cancelled due to a force majeure event. Deposits may be applied to the rebooked Event.
- The guest/client agrees that in hosting an in-suite function he/she will comply with all hotel and front desk policies regarding the suites, hotel property etc. and functions are not in lieu of exhibiting at a convention and agrees to all City-Wide Convention Policies.
