SLO Makerspace and County of San Luis Obispo Public Libraries Memory Lab Policy Acknowledgment

Purpose
The Memory Labs at SLO Makerspace and the County of San Luis Obispo Public Libraries are creative, collaborative, and educational spaces that provide access to advanced software, emerging technologies, production studios, and co-working spaces. Please review the guidelines set forth. Acceptance of and compliance with these provisions is required for your use of the space, tools, equipment, and materials provided within.

Acknowledgement
Please initial each signature line to indicate acceptance and understanding of each line item:
Signature*   _____Prior to using the Memory Lab, Patrons must (a) initial Memory Lab Policy Acknowledgment and sign User Agreement; (b) verify identity with library card; (c)attend a mandatory orientation session to use the equipment/tools/materials in the Memory Lab and SLO Makerspace.
Signature*   _____Patrons must sign in with SLO Makerspace staff each time they come to use the Memory Lab.
Signature*   _____Minors must be accompanied by a guardian or caregiver, always.
Signature*   _____The Patron agrees that if any piece of equipment becomes unsafe or in a state of disrepair, they will immediately discontinue use and notify staff.
Signature*   _____Patrons must report any accident/incident that occurs in the Memory Lab to a staff member.
Signature*   _____Patrons must bring their own storage device for transferring media files. SLO Makerspace and the Library are not responsible for providing a place for storing digital files. All Memory Lab computers are reset, and all files are deleted after each reboot.
Signature*   _____Use of the Memory Lab is subject to SLO Makerspace Rules of Conduct, County of SLO Library Rules of Conduct, SLO Makerspace Internet Use Policies and Library Internet Use Policies. Failure to abide by all applicable policies and procedures will result in suspension or loss of Memory Lab use privileges.
Signature*   _____Transfer of Obscene Materials, or content that is otherwise inappropriate for a public setting, is prohibited.
Signature*   _____Transfer of Copyrighted Materials using the Memory Lab is prohibited by law. By law, individuals cannot transfer copyrighted material unless: 1) user obtained permission from the copyright holder, or 2) the transfer is for fair use purposes. Patrons are responsible for obtaining their own protections for any intellectual property developed in the Memory Lab.
Signature*   _____The individual who reserves the Memory Lab will be considered the main user and is financially responsible for any damages or misuse of equipment.
Signature*   _____SLO Makerspace and the Library are not responsible for any losses, damages, obligations or liabilities directly or indirectly related to the use of its equipment and information resources.

SLO MAKERSPACE AND COUNTY OF SAN LUIS OBISPO PUBLIC LIBRARY MEMORY LAB USER AGREEMENT, WAIVER AND RELEASE

I agree that by singing this form I am asserting that I have read the Memory Lab Policiesand agree to follow all rules, policies, procedures, and restrictions relating to use of it, including but not limited to, the rules stated herein, County of San Luis Obispo Public Library and SLO Makerspace Rules of Conduct, the Library Internet Use procedures, and restrictions may change at any time without notice and that I will make myself aware of all changes or modifications of said rules, policies, procedures, and restrictions.

I agree that by signing this agreement and/or engaging in Memory Lab activities, I shall defend, indemnify, and hold harmless SLO Makerspace, the County of San Luis Obispo Public Library and the County of San Luis Obispo, its officers, officials, employees, and volunteers from and against any and all claims, proceedings, damages, losses, suits including attorney fees and costs, actions, or liabilities for injury or death of any person, or for loss of damage to property, or any other loss in connection with the use of the Memory Lab, including the equipment, tools, and materials therein.

I also understand and agree that I am financially responsible for any and all damage done to Memory Lab equipment resulting in my misuse or failure to follow all rules, policies, procedures, and restrictions relating to use of it. I understand that I am responsible for and agree to pay the repair and replacement costs of the equipment resulting from such actions. I understand that use of the Memory Lab equipment is voluntary. I am aware that I may be exposed to personal injury, or damage to my property arising out of my use of the Memory Lab. Such risks may be as a result of my activities or the activities of others (volunteers, employees, or third parties).

With knowledge of these risks, I agree to accept all risks of personal injury, or damage to my property. In consideration of the same, on behalf of myself, my personal representatives, heirs, next of kin, successors and assigns, forever waive, release and discharge SLO Makerspace, the County of San Luis Obispo Public Library, and County of San Luis Obispo from any and all negligence and liability for my death, disability, personal injury, property damage, property theft or claims of any nature which may hereafter accrue to me, and my estate as a direct or indirect result of my use of the Memory Lab.

I HEREBY CERTIFY THAT I AM EIGHTEEN (18) YEARS OR OLDER; I HAVE READ THIS AGREEMENT, WAIVER AND RELEASE, AND I UNDERSTAND ITS CONTENT.
