• Gentle Hands Supported Living Occupancy Agreement

  • Section 1. Purpose & Scope

    1.1 This property operates as a private rental home for adults.

    1.2 It is not licensed as a care facility and does not provide medical, personal care, or supervisory services.

    1.3 Each tenant is responsible for their own health, safety, and personal needs.

     

  • Section 2. Occupancy Agreement

    2.1 Rent is due on the ________ of each month.
    2.2 Late fees apply after 3 days past due ($10 per day)

    2.3 Returned checks/failed payments incur a $35 fee.

    2.4 Licensure agreement is month-to-month unless otherwise stated.

    2.5 Either party may terminate tenancy with 10 days' written notice.

    2.6 If rent is not paid within the grace period, the tenant will be required to vacate the premises immediately. No community fee will be refunded.

    Spendthrift Clause: Tenant may not assign, transfer, pledge, or otherwise encumber this Agreement or any lease rights or obligations for the benefit of creditors or third parties. Any such attempt is void. This ensures tenancy remains solely between landlord and tenant.

  • Section 3. Payment & Financial Policies

    3.1 Rent is due on the date specified in the Licensure Agreement. 

    3.2 Rent increases require 30 days' written notice. per month. 

    3.3 Utility Cap Policy: Landlord covers up to $___________ per month. Excess may be billed to tenants.

    3.4 Late Rent Escalation: Reminder at 3 days, notice at 4 days, eviction at 10 days if unpaid.

    Section 4. Occupancy & Guest Policies

    4.1 Each room is for one adult occupant unless approved in writing.

    4.2 Guest is allowed only to visit in common areas. Hours are 11am to 7pm daily. Landlord must be notified. 

    4.3 Subleasing and Airbnb/short-term rentals are prohibited.

    Section 5. Safety & Security Policies

    5.1 Fire Safety: No candles, incense, unapproved heaters.

    5.2 Smoke detectors and extinguishers provided; tampering prohibited.

    5.3 Locks: No unauthorized changes/duplication; lost keys incur replacement fee.

    5.4 Lockouts: Fee may apply for after-hours assistance.

    5.5 Weapons: Firearms/weapons prohibited unless legally owned, declared, and safely stored.

    5.6 Security cameras may be used in common areas; never in private rooms/bathrooms.

    5.7 Tenants must provide emergency contact information.

    Section 6. Maintenance & Cleanliness

    6.1 Tenants keep rooms clean and sanitary.

    6.2 Shared spaces (kitchen, bathrooms, laundry) must be cleaned after use.

    6.3 Trash must go in designated bins.

    6.4 Landlord handles major repairs; tenants must promptly report issues.

    6.5 Room Checks: Monthly inspections with 24 hours' notice.

    Section 7. Shared Facilities

    7.1 Kitchens: Label food, clean dishes immediately, discard spoiled food weekly.

    7.2 Bathrooms: Keep sanitary after each use.

    7.3 Laundry: Restricted to posted hours; remove clothes within one hour.

    7.4 Parking: One vehicle per tenant, registered with landlord. No inoperable or repair work. Unauthorized vehicles may be towed.

  • Section 8. Health & Behavior Policies

    8.1 Monthly cleanliness inspections of common areas may occur.

    8.2 Pest control treatments may be scheduled; tenants must comply.

    8.3 Alcohol permitted in moderation; no parties/kegs.

    8.4 Smoking/Vaping/Marijuana allowed only in designated outdoor areas in compliance with law.

    8.5 Infectious Disease: Tenants must follow public health guidelines.

    8.6 Harassment, fighting, threats, or disruptive behavior will not be tolerated.

    Section 9. Emergency Procedures

    9.1 Fire: Evacuate immediately and call 911.

    9.2 Severe Weather: Seek shelter in basement or posted safe room.

    9.3 Medical Emergencies: Call 911. Landlord is not a caregiver.

    9.4 Annual evacuation drills will be conducted.

    9.5 Emergency contacts and exit maps are posted in common areas.

    Section 10. Privacy & Respect

    10.1 Tenants have privacy in their rooms.

    10.2 Landlord will provide 24 hours' notice before entering (except emergencies

    10.3 Respect others' property and personal space.

    10.4 No recording/photos of other tenants without consent.

    10.5 Tenants must keep noise at a respectful level at all times. Quiet hours are from 10:00 p.m. to 7:00 a.m. Noise (TVs, music, conversations) must be minimal and not disturb others. Repeated violations may lead to warnings or termination of the agreement.

    Section 11. Prohibited Activities

    11.1 Running businesses without approval.

    11.2 Illegal activities of any kind.

    11.3 Tampering with electrical/plumbing systems.

    11.4 Property damage, graffiti, or vandalism.

    11.5 Commercial deliveries or operations that create nuisance.

  • Section 12. Move-In / Move-Out Policies

    12.1 Room inspection checklist completed at move-in and move-out.

    12.2 Tenants must give 30 days' written notice before vacating.

    12.3 Abandoned property handled per Missouri law.

    12.4 If room left in poor condition, repair/cleaning fees may be deducted.

    12.5 Large Item Disposal: Tenants must arrange removal of large items or fees may apply.

    12.6 Alterations/Decorations: No painting/drilling without approval.

    12.7 Furniture (if provided) must remain in room and undamaged.

    Section 13. Legal & Compliance

    13.1 Spendthrift Clause: Tenants shall not assign, transfer, pledge, or otherwise encumber their lease rights or rent obligations for the benefit of creditors or any third party. Any such attempt will be void and of no effect. This ensures that tenancy rights and obligations remain strictly between the landlord and the tenant.

    13.2 This property does not provide healthcare/personal care services.

    13.3 Equal Housing Opportunity: No discrimination based on protected classes.

    13.4 Tenants must comply with all city/county/state laws and ordinances.

    13.5 Dispute Resolution: Written complaints will be reviewed; mediation may be considered.

    13.6 Liability Disclaimer: Landlord not responsible for theft/damage to tenant belongings. Renters' insurance strongly encouraged.

    13.7 Hold Harmless: Tenants agree landlord is not responsible for injuries caused by tenant negligence.

    13.8 Gentle Hands Supported Living complies with all applicable fair housing and accessibility laws. Reasonable accommodations may be considered upon request in accordance with federal, state, and local regulations.

    Section 14. Acknowledgment of Policies

    14.1 I acknowledge that I have received, read, and understand the Gentle Hands Supported Living Licensee Agreement Policy Manual & Room Agreement.

    14.2 I agree to comply with all policies and understand violations may result in lease termination.

    14.3 This agreement is a Licensure Agreement, not a lease. It provides emergency occupancy and does not establish a landlord-tenant relationship.
