TERMS AND CONDITIONS
These Terms and Conditions govern all travel and charter arrangements with Peacock River Masters, herein referred to as “the Company.” By confirming participation, the Client acknowledges full acceptance of the terms stated below.
1. Rescheduling
If the Client needs to reschedule the trip, it may be done up to one (1) year prior to the original departure date, subject to availability and any applicable rate adjustments between seasons. Requests made after this period are subject to the Company’s discretion.
2. Cancellation Policy
A. Cancellations by the Client
• More than 90 days before departure: 40% penalty of the initial deposit.
• Between 60 and 30 days before departure: 60% penalty of the total package value, or the option to reschedule within the same season.
• Less than 30 days before departure or no-show: 100% penalty applies.
B. Transfer of Reservation
The Client may transfer the package to another individual on the same scheduled date at no additional cost, provided the Company is notified in advance and approves the substitution.
3. Minimum Group Requirement
Peacock River Masters reserves the right to operate only with a minimum of 10 anglers per week. Should this requirement not be met 60 days before departure, guests will be rescheduled to a later available date at no additional cost.
4. Liability and Force Majeure
The Company is not responsible for:
• Delays, cancellations, or changes caused by weather, river conditions, or other natural events.
• Actions or omissions of third-party service providers outside its direct control.
• Any events constituting force majeure, including strikes, political unrest, pandemics, or governmental restrictions.
5. Fishing Conduct and Environmental Responsibility
Guests must strictly adhere to sustainable and legal fishing practices. Any use of prohibited or predatory methods may result in immediate termination of participation without refund and potential legal or environmental penalties.
6. Assumption of Risk
The Client acknowledges that sport fishing and navigation in remote areas involve inherent risks, including but not limited to wildlife encounters, weather changes, or logistical delays. The Client voluntarily assumes all risks not directly resulting from proven negligence by the Company or its employees.
7. Medical Responsibility and Emergency Evacuation
• The Client is solely responsible for carrying personal medications and informing the crew of any relevant health conditions prior to departure.
• In the event of illness, accident, or any medical emergency, all related costs—including but not limited to emergency transportation, extraction from remote areas, medical treatment, and hospital expenses—shall be the sole responsibility of the Client.
• The Company and its agents may, at their discretion, arrange for emergency evacuation or medical assistance; however, all associated expenses must be reimbursed by the Client.
• The Company highly recommends that each participant obtain comprehensive travel and medical insurance that includes coverage for medical emergencies, evacuations, cancellations, and trip interruptions.
8. Health and Vaccination Requirements
It is the Client’s responsibility to maintain an up-to-date vaccination record as required by the Brazilian Health Ministry and to comply with any health and entry regulations in force at the time of travel.
9. Behavior and Conduct
The Company reserves the right to terminate participation without refund if the Client engages in behavior that endangers others, the environment, or the vessel’s safety.
The Client is liable for any damage or loss caused by misconduct or negligence.
10. Image and Video Rights
The Client grants Peacock River Masters permission to use photographs or videos captured during the trip for marketing and promotional purposes, without compensation.
The Company guarantees that the Client’s image will be used respectfully and appropriately, and consent may be withdrawn in writing prior to publication.
11. Governing Law and Jurisdiction
Any dispute or claim arising from this agreement shall be governed by the laws of Brazil. The District Court of Manaus, State of Amazonas, is elected as the exclusive jurisdiction for all legal matters related to this contract, with the express waiver of any other.
