This agreement is made between Equine Empowerment Foundation hereinafter referred to as E.E.F.) with its Stabling Site at 1107 Waverly Heights Dr, Thousand Oaks, CA, and the Riding Arena is located at the Conejo Creek Equestrian Park, Thousand Oaks, CA, and the PARTICIPANT

2. ACKNOWLEDGMENT OF "RUGGED ADVENTURE" & INHERENT RISKS

I acknowledge that horseback riding is a "RUGGED ADVENTURE RECREATIONAL SPORT ACTIVITY." Horses are innately dangerous, large, and powerful animals with unpredictable instincts. Risks include: bucking, stumbling, falling, rearing, biting, kicking, spooking, bolting, spinning, stopping suddenly, backing up quickly, refusal to move forward, jumping, and stepping on, running over, trampling, or dragging a rider. Equipment failure (saddles, bridles, cinches) and unpredictable reactions to sounds or terrain are also inherent risks. I specifically acknowledge that Adaptive Riding is a high-risk activity due to specialized physical and cognitive demands.

3. PRIMARY ASSUMPTION OF RISK

Under California’s primary assumption of risk doctrine, the "Released Parties" (Equine Empowerment Foundation, officers, instructors, trainers, agents, volunteers, property owners, etc.) have no legal duty to protect me from risks natural to equine activities. I voluntarily assume the risk of injury or death resulting from the inherent risks of domestic animal activities.

4. RELEASE OF LIABILITY (ORDINARY NEGLIGENCE) & LEGAL NOTICES

I RELEASE, WAIVE, AND DISCHARGE the Released Parties from all claims arising from ordinary negligence.

GROSS NEGLIGENCE: Per the CA Supreme Court (Santa Barbara v. Superior Court), this agreement does not waive liability for gross negligence (an extreme departure from ordinary conduct), reckless actions, or intentional misconduct.
CIVIL CODE § 1542: I expressly waive California Civil Code Section 1542, which protects against unknown claims at the time of signing.

5. SAFETY

Helmet: An ASTM/SEI-approved riding helmet is mandatory for all mounted activities.

6. SEVERABILITY AND GOVERNING LAW

If any portion of this Agreement is found to be invalid, the remainder shall continue in full legal force and effect. This Agreement is governed by the laws of the State of California.

7. EXECUTION

"The Undersigned" includes the participant, minor child, and parents/guardians.
