This Assumption of Risk, Release of Liability, and Indemnity Agreement (“Agreement”) is entered into between the undersigned participant (the “Participant”) and HoopHouse Brampton Ltd., its directors, officers, owners, employees, volunteers, agents, contractors, landlords, and affiliates (collectively, the “Released Parties”).
By signing this Agreement electronically, the Participant acknowledges and agrees as follows:
1. ACKNOWLEDGEMENT OF RISKS
The Participant understands and acknowledges that participation in basketball, training, or other activities at HoopHouse Brampton (the “Facility”) involves inherent risks, including but not limited to:
Collisions with other participants, groups, or equipment;
Slips, trips, or falls on wet or slippery floors caused by moisture, condensation, or cleaning processes;
Contact injuries from basketballs, walls, or structures;
Equipment malfunction or failure;
Temperature or humidity variations;
Any other hazards that may result in injury, disability, or death.
The Participant freely and voluntarily assumes all such risks, known and unknown, related to use of the Facility.
2. RELEASE AND WAIVER OF LIABILITY
The Participant hereby waives, releases, and forever discharges the Released Parties from any and all claims, demands, or causes of action arising from participation in Facility activities, including but not limited to those caused by ordinary negligence, accidents, or property loss.
3. INDEMNIFICATION
The Participant agrees to indemnify and hold harmless the Released Parties from all claims or liabilities arising from their participation, conduct, or breach of Facility rules.
4. RULES AND SAFETY
The Participant agrees to obey all Facility rules, posted signs, and staff instructions. Unsafe conduct, rough play, or interference with other groups may result in removal from the Facility without refund.
5. MEDICAL AUTHORIZATION
The Participant authorizes HoopHouse Brampton staff to obtain emergency medical treatment as deemed necessary and agrees to be financially responsible for related expenses.
6. PARENT/GUARDIAN CONSENT (IF UNDER 18)
I, the undersigned parent or guardian, consent to my minor child’s participation in activities at the Facility and agree to all terms of this Agreement. I further agree to indemnify and hold harmless the Released Parties from any claims arising from the minor’s participation.
7. SEVERABILITY
If any provision of this Agreement is held invalid, the remaining provisions shall remain enforceable.
8. GOVERNING LAW
This Agreement is governed by the laws of the Province of Ontario and the applicable laws of Canada. Venue for any dispute shall be exclusively in Ontario courts.
9. ACKNOWLEDGEMENT
By checking the box and signing below, the Participant confirms they have read, understood, and voluntarily agree to this legally binding Agreement.
