At Kalisi Kids, we foster a safe, empowering environment for children to grow and thrive. By signing this waiver, you agree to the following terms and conditions, crafted in accordance with British Columbia law, to ensure a safe and enjoyable experience for all.
1. Release and Waiver of Liability
I, the undersigned parent/guardian, acknowledge that participation in activities at Kalisi Kids, including but not limited to play areas, events, programs, or other services, involves inherent risks of personal injury, property damage, or loss. To the fullest extent permitted by the laws of British Columbia, I hereby release, waive, discharge, and covenant not to sue Kalisi Kids, its parent company, subsidiaries, affiliates, officers, directors, employees, volunteers, agents, and representatives (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any injury, loss, or damage (including death) sustained by myself or my child(ren) while participating in activities at Kalisi Kids, whether caused by negligence of the Released Parties or otherwise, except in cases of gross negligence or willful misconduct. I understand this release is binding on me, my child(ren), and our heirs, executors, administrators, and assigns.
2. Assumption of Risk
I acknowledge that activities at Kalisi Kids involve physical activities that carry inherent risks, including but not limited to falls, collisions, or equipment-related injuries. I voluntarily assume all risks associated with participation, on behalf of myself and my child(ren), and confirm that my child(ren) is/are physically capable of participating.
3. Facility Rules and Policies
To maintain a safe and healthy environment, all participants must comply with the following:
• No Alcohol or Smoking: The consumption of alcohol and smoking (including vaping or use of any tobacco or cannabis products) are strictly prohibited on the premises, including all indoor and outdoor areas, in accordance with BC’s Tobacco and Vapour Products Control Act and Liquor Control and Licensing Act.
• Food and Drink Restrictions: No food or drinks may be brought into the Kalisi Kids Centre unless explicitly authorized by management. All food brought onto the premises must comply with food safety standards set by the Vancouver Island Health Authority (VIHA).
• Sock Requirement: All individuals entering the Kalisi Kids Centre, including children and adults, must wear socks at all times to ensure hygiene and safety.
• Zero Refund Policy: All payments for events, bookings, or services are non-refundable under any circumstances, as permitted under BC’s Business Practices and Consumer Protection Act.
• Cleanup Fee: A mandatory cleanup fee of $50 per hour will be charged for any cleaning required beyond what is included in the booked package. This fee is separate and not covered by standard package rates. To avoid this cause you are welcome to clean up after yourselves.
4. Health and SafetyI confirm that my child(ren) is/are in good health and capable of participating in activities at Kalisi Kids. I agree to inform staff of any medical conditions, allergies, or special needs that may affect their participation. In case of emergency, I authorize Kalisi Kids staff to seek medical attention for my child(ren) if I cannot be reached, in accordance with BC’s Health Care (Consent) and Care Facility (Admission) Act.
5. Photography and Media
I grant Kalisi Kids permission to photograph or record any child(ren) during activities for promotional or documentation purposes, unless I provide written notice to opt out at the time of signing. I understand that such media may be used in accordance with BC’s Personal Information Protection Act (PIPA). I acknowledge that if I do not want my child or one of my guest in photos are recordings that I will make the staff know in advance by email.
6. Governing Law
This waiver and any disputes arising from it shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any legal proceedings shall be brought exclusively in the courts of British Columbia.
7. AcknowledgmentI have read, understood, and agree to abide by all rules and policies outlined above.
I acknowledge that failure to comply may result in removal from the premises without refund. By signing below, I confirm my commitment to ensuring a safe, respectful, and enjoyable experience for all at Kalisi Kids, and I agree to the release of liability for Kalisi Kids and all its subsidiaries as outlined above.
