NAFRET - MEMBERSHIP DECLARATION & DISCLAIMER
I, the undersigned, hereby apply for membership to NAFRET (the “Organisation”) as a small business (the “Member”). In connection with my membership application, I make the following solemn declarations, acknowledgments, and undertakings:Legality and ComplianceI declare that I am a South African citizen or a foreign national lawfully entitled to conduct business in the Republic of South Africa in my own name, with full legal capacity and compliance with all applicable laws, including immigration and registration laws.No Fronting or MisrepresentationI confirm that I will not engage in fronting, i.e. I shall not hold myself out as the legal representative or nominee owner or operator of any business in whole or in part on behalf of any foreign national (whether documented or undocumented). I understand that fronting for undocumented foreigners (assisting them in registering businesses, obtaining licenses, or operating business enterprises) is expressly prohibited under Section 42 of the Immigration Act 13 of 2002. Criminal Liability Under the Immigration ActI acknowledge that aiding, abetting, or assisting an illegal foreigner in conducting business, obtaining licenses, or any related activity is a criminal offence under Section 42 of the Act. I understand that a conviction under Section 42 may lead to:Imprisonment (the Act contemplates penalties including up to five (5) years in certain cases) A monetary fine (as prescribed by the courts)
