  • 1. Purpose

The parties agree to collaborate on a creative photo session (“Session”) for the purpose of producing photographic works for portfolio and promotional use. The Collaborator will provide creative services (e.g., makeup, styling, wardrobe, art direction, or assistance) in exchange for access to final edited images for personal promotional use.

  • 2. Consideration

This is a collaborative, non-monetary arrangement. No payment is being exchanged unless otherwise stated in writing. The Collaborator acknowledges that participation is voluntary and that the Photographer will share a selection of edited images for portfolio use following the completion of the Session.

  • 3. Usage Rights

    • The Photographer retains full copyright and ownership of all images created during the Session.
    • The Collaborator is granted non-exclusive permission to use the delivered edited images for personal portfolio, social media, website, or printed promotional materials.
    • The Collaborator agrees not to alter or edit the images beyond cropping or resizing without the Photographer’s written consent.
    • The Collaborator may not sell, license, or submit the images to third parties, publications, or commercial campaigns without written consent from the Photographer.
    • Proper credit (e.g., “Makeup by [Name] / Photo by Jerrard B Photos”) must accompany any shared use whenever reasonably possible.

  • 4. Photographer Rights

The Photographer may use the images for portfolio, website, social media, editorial, or fine-art purposes. The Photographer may license or exhibit the images, provided such use does not misrepresent or defame any collaborator or their work.

  • 5. Fine Art and Commercial Use

If images from this Session are later licensed, published for profit, or sold as fine art, the Photographer will notify the Collaborator as a professional courtesy. The Collaborator acknowledges that such uses are part of the Photographer’s artistic rights and do not require additional payment unless otherwise agreed in writing.

  • 6. Creative Contributions and Copyright

The Collaborator grants the Photographer a perpetual, worldwide, royalty-free license to photograph, reproduce, and display any artwork, design, makeup, styling, or other creative contribution they have produced or applied for the Session.

This license includes use in all media for editorial, promotional, or fine-art purposes. The Collaborator waives any claim of copyright or ownership to such contributions as they appear within the final photographic works.

  • 7. Limitations

All parties agree to maintain professional standards and to avoid using images in a defamatory, misleading, or offensive context.

  • 8. Release and Waiver

The Collaborator releases the Photographer from any claims arising from lawful use of the images. This agreement represents the entire understanding between the parties.

  • 9. Delivery

The Photographer will provide all session collaborators with access to the proof gallery within 7 days of the Session for review and reference. Proofs will have been pre-culled and lightly adjusted for exposure, white balance, and crop.

The Photographer and Model will select the final images to be fully edited and delivered. Collaborators may request specific images for portfolio use; such requests will be considered on a case-by-case basis at the Photographer’s discretion.

Final edited images will typically represent approximately 10–20 percent of the proof gallery and will be delivered as high-resolution JPEGs via Google Drive within a reasonable timeframe after final selections are made.

Unedited or RAW files will not be released. Any additional edits or alternate versions beyond the agreed selections may be completed at the Photographer’s discretion or under a separate agreement.
