Agreement of Release and Waiver of Liability
I AGREE TO THE FOLLOWING: That the instruction offered by Jayme Fenwick is limited to that of instruction in yoga. I acknowledge that even with clear instruction, there is a possibility of injury. I agree that it is my responsibility to consult a physician prior to and regarding my participation in the Activities, and I represent and warrant that I am physically fit and I have no medical condition which would prevent my full participation in these Activities. I release and discharge Jayme Fenwick, its directors, staff, shareholders, officers, and the company itself from any and all liability, claim, demand, or action that I may have resulting from injury, death, or damages arising from my participation in the yoga class or at the yoga studio from my participation in any yoga classes, attendance at the yoga studio or involvement in any events or activities relating to Jayme Fenwick, including loss that may be caused by the negligence of the released party. I hereby grant Jayme Fenwick permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all photos will become the property of Jayme Fenwick and will not be returned. I hereby irrevocably authorize Jayme Fenwick to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo. I hereby hold harmless, release, and forever discharge Jayme Fenwick from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization. I understand clearly that the Releasees would not permit me to participate in any such Activities unless I signed this Agreement. I acknowledge and agree that this Agreement applies to all the aforesaid Activities whether occurring in the near or distant future, and that the terms ofthis Agreement need not be brought to my attention each time I participate in the Activities in order to be effective. By selecting "I AGREE", I recognize and understand that this agreement of release and waiver of liability is a legal contract and that, by reading it carefully, I have complete knowledge of its contents. I have read this agreement and fully understand its contents and meaning.
