• Optimise for Success (Resilience Coaching) Agreement

  • 1. Purpose and Scope

  • This agreement outlines the terms under which Brainwave Coaching (Susanna Sweeney MSc and Associates) provides resilience coaching and related psycho-educational services to the Client. Coaching may take place one-to-one, in groups, online, or in person depending on the service purchased.

  • 2. Duration and Access

  • Access to coaching materials and group sessions corresponds to the payment plan chosen at checkout. For example, a 12-week payment plan provides 12 weeks of group access, a 24-week plan provides 24 weeks.

  • 3. Payment Terms

  • All fees are payable as outlined at checkout. If a payment fails, the Client will be notified and has five (5) days to correct it. If payment is not completed within that time, services and access to materials will be suspended or terminated. Any outstanding balance remains payable. Access resumes only once payment is complete.

  • 4. Cancellations, Refunds, and Rescheduling

  • As course materials include protected intellectual property and are delivered electronically, once access is granted the Client waives any right to refund under EU consumer law. No refunds are available once materials are accessed.For one-to-one sessions, at least 48 hours’ notice must be given to reschedule. Sessions cancelled or missed without 48 hours’ notice are forfeited. Missed sessions or no-shows cannot be replaced. Clients are responsible for checking appointment times against their own time zone.

  • 5. Confidentiality and Data Protection

  • Confidentiality is a core value of this work. All personal information shared in coaching sessions is treated as confidential and will not be disclosed unless required by law (for example, where there is a risk of harm to self or others).

    Participants in group sessions also agree to maintain confidentiality. This includes not sharing what was discussed, what occurred, or who attended.Brainwave Coaching (Susanna Sweeney MSc and Associates) complies with the General Data Protection Regulation (GDPR). Personal data are collected and processed solely for the purpose of delivering coaching services, stored securely, and never shared with third parties without consent. Clients can request access to, correction of, or deletion of their data at any time by emailing brainwavehypnotherapygalway@gmail.com

  • 6. Nature of the Work

  • Services under Brainwave Coaching combine elements of coaching and psycho-educational work informed by depth-psychological principles. While Susanna Sweeney MSc is an accredited psychotherapist with over 30 years of experience in trauma work, all services delivered under Brainwave Coaching are provided in a coaching and educational capacity and do not constitute psychotherapy or medical treatment.

  • 7. Responsibility and Results

  • Results vary from person to person and cannot be guaranteed. Progress depends on the Client’s engagement with the process. The Client is responsible for applying what is learned and for their own wellbeing throughout the program.

  • 8. Conduct and Termination

  • Either party may terminate this agreement at any time with written notice. Brainwave (Susanna Sweeney & Associates) reserves the right to end the agreement immediately if:the Client fails to make payment,the Client breaches confidentiality,the Client behaves abusively, disruptively, or disrespectfully toward any staff member or participant,the Client misuses materials or intellectual property, orthe Client otherwise acts in a way that undermines the work.In such cases, no refund will be issued, and any outstanding balance remains payable.

  • 9. Intellectual Property

  • All course materials, written content, videos, and resources remain the intellectual property of Brainwave Coaching (Susanna Sweeney MSc and Associates). They are provided solely for the Client’s personal use and may not be reproduced, shared, or distributed in any form to non-paying parties.

  • 10. Complaints

  • If the Client has a concern or dissatisfaction, they agree to raise it directly with Brainwave Coaching by email before making any public statement. Brainwave Coaching will respond in writing and make reasonable efforts to resolve the matter promptly and professionally.

  • 11. Non-Disparagement

  • The Client agrees not to make any false, misleading, or defamatory statements about Brainwave Coaching, its staff, or services in any public or online forum.

  • 12. Disclaimer

  • Clients who have been diagnosed with depression, anxiety, or any medical or mental health condition should remain under the care of their medical provider. Coaching is not a replacement for medical treatment or psychotherapy, and no medical advice is given.

  • 13. Governing Law

  • This agreement is governed by and interpreted under the laws of Ireland. Any dispute arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the Irish courts.

  • 14. Entire Agreement

  • This document constitutes the entire agreement between the parties and supersedes all prior discussions or understandings.

  • 15. Testimonials

  • By providing a testimonial or review, the Client grants permission for it to be used for marketing purposes, including on websites and social media, with first name and general location unless otherwise requested in writing.

  • 16. Acceptance of Terms

  • By signing this agreement, the Client confirms that they have read and understood these terms in full, that they agree to be bound by them, and that they consent to these terms applying retroactively to the commencement of services and access already granted.
