Model Release Agreement

This Model Release Agreement (“Agreement”) is entered into between the undersigned model (“Model”) and Atlas Swimwear, LLC, including its owners, employees, agents, affiliates, licensees, partners, successors, and assigns (“Company”).

By signing below, the Model (or Parent/Legal Guardian if the Model is a minor) agrees to the following terms:

1. Permission to Use Likeness

The Model grants the Company the absolute, unrestricted, and irrevocable right to photograph, film, record, and otherwise capture the Model’s image, likeness, voice, appearance, and performance (“Content”) in any form, including still photos, video, audio, digital imagery, and any other media now known or later developed.

The Model grants the Company full rights to use, publish, reproduce, distribute, display, modify, edit, and create derivative works from the Content for any lawful purpose, including but not limited to:

• Advertising

• Social media

• Website usage

• Print media

• Digital campaigns

• E-commerce

• Branding and promotional materials

• Editorial, commercial, or marketing use

No further approval or payment is required.

2. Brand Integrity & Conduct

The Model acknowledges that Atlas Swimwear maintains a premium brand reputation and agrees to conduct themselves in a manner consistent with professionalism, brand values, and brand integrity at all times during the shoot and in relation to the published Content.

The Model agrees not to post or share behind-the-scenes imagery, video, or commentary about the shoot or the Company without written approval.

The Company reserves the right to refrain from using any Content if the Model engages in actions that may harm the brand’s reputation.

3. Rights & Ownership

All Content created by or for the Company is the exclusive property of Atlas Swimwear, LLC.

The Model has no ownership rights, approval rights, royalty rights, or claims to future compensation related to the Content.

4. Release of Claims

The Model releases the Company from any and all liability, claims, demands, or actions arising from the creation, use, distribution, or publication of the Content, including but not limited to claims for defamation, invasion of privacy, right of publicity, emotional distress, or misuse of images.

The Model understands that the Content may be used publicly, internationally, permanently, and in multiple contexts, and waives any right to inspect or approve the final materials.

5. No Obligation to Use

The Company is not obligated to use the Model’s Content in any manner, and the Model understands that selection and usage of Content is at the sole discretion of Atlas Swimwear.

6. Compensation

Unless otherwise stated in a separate written agreement, the Model understands that participation is voluntary and no financial compensation, royalties, or future payments are owed.

7. Confidentiality

All information, concepts, designs, products, and visuals seen during the shoot may be confidential or unreleased intellectual property.

The Model agrees not to disclose, share, or reproduce any confidential information without written permission.

8. Indemnification

The Model (and Parent/Guardian, if applicable) agrees to indemnify, defend, and hold harmless the Company from any claims, losses, damages, or legal fees resulting from:

• The Model’s conduct

• Misrepresentation of age or authority

• Violation of this Agreement

• Third-party claims related to the Model’s actions

9. Governing Law

This Agreement is governed by the laws of the State of Kansas. Any legal dispute must be resolved within the applicable jurisdiction in Kansas.

By signing below, I acknowledge that I have read, understood, and agree to all terms outlined in this Model Release Agreement. I confirm that I am at least 18 years of age and legally authorized to enter into this Agreement.*

10. Minors (Models Under Age 18)

If the Model is under the age of 18, this paragraph applies:

The Parent/Legal Guardian grants full permission for the minor to participate in the shoot and grants all rights outlined in this Agreement on the minor’s behalf.

11. The Parent/Legal Guardian further agrees to:

• Ensure the minor’s compliance with brand integrity and professionalism

• Waive all claims against the Company

• Accept full responsibility for the minor during production

• Indemnify and hold the Company harmless from any claims arising from the minor’s participation
