The undersigned expressly acknowledges that parade activities, including pre-parade and post-parade activities, are inherently dangerous and may involve the risk of serious injury, death, and/or property damage. The undersigned agrees to indemnify, defend, and hold harmless the Uvalde Area Chamber of Commerce, its affiliates, employees, agents, officers, volunteers, contractors, and representatives, from and against any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable attorney’s fees) arising out of or related to any personal injury, death, or property damage suffered by any person as a result of, or in connection with, the actions or omissions of the parade participants connected with the undersigned’s group, float, organization, or individuals. The undersigned and all participants associated with this parade entry understand and voluntarily assume all risks associated with their entry into and participation in any parade organized, sponsored, or administered by the Uvalde Area Chamber of Commerce, including but not limited to all preparation, lineup, staging, and dispersal activities before, during, and after the parade.

By signing and submitting this application, and as a condition of my entry into any parade or event organized, sponsored, or administered by the Uvalde Area Chamber of Commerce, I hereby consent to the public and commercial use, display, publication, performance, reproduction, copying, distribution, transmission, alteration, adaptation, creation of derivative works, and/or translation of my name, voice, image, likeness, signature, trade dress, biography, photograph, video images, and any and all other publicity rights, whether taken, recorded, captured, or created at or during the event. I hereby grant to the Uvalde Area Chamber of Commerce, including its direct and indirect parents, subsidiaries, licensees, sublicensees, and affiliates (collectively, “Uvalde Chamber of Commerce”), ownership of all rights, copyrights, and other intellectual property rights in and to all such broadcasts, films, videotapes, recordings, photographs, and audiovisual works. I further grant to the Uvalde Chamber of Commerce the unrestricted right to use, display, publish, perform, reproduce, copy, alter, create derivatives of, translate, distribute, transmit, license, and otherwise exploit my name, voice, image, likeness, photograph, trade dress, and appearance in connection with the promotion, advertising, or advancement of any Chamber-sponsored parade or related event. I hereby waive any rights of inspection or approval of my appearance or of any uses to which my appearance may be put. I also expressly waive any and all moral rights I may have in connection with my appearance, as set forth in this Publicity Consent and Release.

I acknowledge that the risks associated with parade participation arise not only from the act of participating, but also from riding on a float, walking on the street, or otherwise being present along the parade route. I am fully aware that my participation, and that of all individuals involved in my parade entry, is undertaken with the express understanding, appreciation, and assumption of any and all risks involved, including those described above. I intend that this assumption of all risks shall be legally binding and serve as a complete bar to any and all claims (as defined in the “Release and Waiver of All Legal Liability and Covenant Not to Sue”) that may be brought by me or by my personal representatives, heirs, next of kin, executors, administrators, assigns, estate, or any other person or entity acting on my behalf. This assumption of risk applies to all risks arising from, relating to, or in connection with my participation in or presence at any parade organized, sponsored, or administered by the Uvalde Area Chamber of Commerce. I further acknowledge that, as of the date of my signature below, I have read, understood, approved, and voluntarily assumed all such risks associated with participation.

This Agreement, and any dispute, claim, or controversy arising out of or relating to it, shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. All disputes arising from or relating to this Agreement shall be brought and resolved exclusively in a state or federal court located within the State of Texas, and I hereby consent to the personal jurisdiction and venue of such courts. If any provision of this Agreement is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such determination shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect. The provisions of this Agreement, including but not limited to all waivers, releases, indemnities, and covenants, together with all commitments and obligations of the undersigned hereunder, shall survive the termination, expiration, or completion of participation in any event or activity organized, sanctioned, or affiliated with the Uvalde Area Chamber of Commerce.
